Ā This is regarding Disciplinary proceedings under Rule 9 of CCS (Pension) Rules, 1972 against the officials upto the rank of Asstt. Superintendent are being dealt with in the V.P. Division of this Directonate. Dur,ing the examination of the cases, it has been noticed that departmental proceedings are not conducted in accordance with provisions of the CCS(CCA) Rules , 1965 and CCS(Pension) Rules, 1972 and instructions/clarifications issued thereunder from time to time. Due to which disciplinary proceeding are taking a long time, which defeats the very purpose of initiating the said proceedings. There are number of instances where penalty orders have been set asides by the Hon'ble CAT/Court due to procedural/technical lapses or due to inordinate delay in finalizing thd disciplinary proceedings. 2. While examining one case under Rule 9 of CCS(Pension) Rules, 1972 it has been noticed that a chargesheet in accordancewith the Rules 14 &15 of CCS(CCA) Rules, 1965 was issued by Director Postpf Service to delinquent official. But Chief Posimaster who was also an lnquiry Officer in that case, had 'appointed Presenting Officer and issued disagreement note on LO. rBport under hjs s'i$nature, which is in vioiation of provisions of CCS(CCA) Rules 1965. ,- 3. While conside+ing the case, the Minisier of (C&lT) has taken serious view on such ,--technica!/pr.oceC.u,ral -lapse in conducting proceedings which lead to get benefit to the _eharged officer in disciplinarjy pnoceedings. Therefore,'he has directed'that all the eit'cies may be requested to endure that delinquent staff does not get benefit of such procedural/technical lapses in disciplinary proceeding. lf such instances are brought to light, action may be taken against offir:ers who allowed such technical/procedural deficiencies. 4. You are, therefore, rpquested that all the authoriiies under your conirol may be directed that provisions maQe under CCS(CCA)Ru|e, 1965 and CCS(Pension) Rules,1972 and instruciions therein issued from time to time may be followed properly and strictly in all the disciplinary proceedingS antC ensure thai no proceduralitechnical deficiencies occurred for which delinquent staTf may get benefit of such procedural/technical deficiencies. Such instances, if corne te-r the notiee, vrill be regarded as dereliction to the duiy anei suiiabie aciisn will be taken against the ofiicers who found responsible for such technicai/procecjurai lapses. lt is also requested that all the officer in your cir,cle should be made familiarize with rules and essential procedule requirements of the disciplinary proceedings, to avoid delay in finalizing the cases due to procedural lapses.Ā
The final message of a woman executed in Iran for killing a man she said tried to rape her has been released, telling her mother she would have justice in "the court of God".
Reyhaneh Jabbari, 26, wasĀ hanged on SaturdayĀ despite an international campaign for her release over her seven years in prison.
She left her final will in a voice message to her mother, Shole Pakravan, in April, according to theĀ National Council of Resistance of Iran (NCRI), which released the English translation.
Ms Jabbari recorded it on the day she learned she would be executed, saying she had "given in" to death.
"Dear Sholeh, don't cry for what you are hearing," she said.
"The world did not love us - it did not want my fate.
"In the court of God I will charge the inspectors...and all those that out of ignorance or with their lies wronged me and trampled on my rights and didn't pay heed to the fact that sometimes what appears as reality is different from it."
She was sentenced to death by a Tehran court in 2009 for killing Morteza Abdolali Sarbandi, a former employee of Iran's Ministry of Intelligence who she said tried to sexually abuse her, and the verdict was upheld by Iran's Supreme Court despite a legal challenge.
Judges ruled that she stabbed him in the back in 2007 after purchasing a knife two days earlier but although she admitted stabbing him once, she claimed another man killed him.
In her message, Ms Jabbari said she believed she would have been murdered that night if she had not fought back.
"My body would have been thrown in some corner of the city, and after a few days, the police would have taken you to the coroner's office to identify my body and there you would also learn that I had been raped as well," she said.
"The murderer would have never been found since we don't have their wealth and their power."
Her escape from death only led her to the "grave" of the notorious Evin Prison, where she claimed she was tortured by interrogators.
Her case drew international outcry and sparked a petition demanding her release, which collected almost 242,000 signatures.
Court documents said the execution was carried out after Sarbandi's family refused to pardon Ms Jabbari or accept blood money.

Asking her mother to ensure her organs were donated after her death, Ms Jabbari said she did "not want to rot under the soil".
"I am telling you from the bottom of my heart that I don't want to have a grave for you to come and mourn there and suffer. I don't want you to wear black clothing for me.

It said in all cases of air travel the lowest air fare tickets available for entitled class are to be purchased. "No companion free ticket on domestic/international travel is to be availed of," it added.
Referring to jobs in government departments, it said there will be a total ban on new posts and those that have remained vacant for more than a year will not be filled except "under very rare and unavoidable circumstances". The Finance Ministry has also asked the departments to avoid bunching up expenditure in the last quarter to ensure that there is no infructuous or wasteful spending. It said the Secretaries would be responsible to ensure compliance of the austerity measures and the Financial Advisors would be required to submit reports to the Finance Ministry on a quarterly basis.
