Hello puys, the legislature, the executive and the judiciary are known as the three pillars of the India democracy ( though Media is sometimes referred as the fourth pillar). They have been designed their specific roles by the Indian Constitution. Article 122 and 212 make absolutely clear the defined spheres of the judiciary and the legislature respectively. However, lately there have been many incidents latest being the sealing issue in Delhi,where in the Judiciary has actively participated and played a crucial role in matters that are supposedly not under its preview.

It would have been great if all three of them would have been working perfectly. However, in India the former two have been highly corrupt, inefficient and also unapproachable (lack of handling grievances). The Judiciary on the other hand has been an independent body from the very beginning. Although judges too are known to be corrupt, Judiciary still stands out amongst the three.

Ordinary citizens have little hope in the legislature and executive and judiciary seems to be their only hope. In the past, the Supreme Court successfully handled the many issues like that of CNG buses in Delhi. I dont think that the executive could have done a better job. Those of us from Delhi would certainly agree with that.

So, what could be wrong with the Judiciary stepping in. Well, the legislature is directly elected by the people and can be voted out but the judiciary is not elected by the people. But when elected representatives have abdicated their responsibilities and some else is doing the job effectively, should its wings be clipped or not?? When you have to choose between the devil and the deep sea, what do you do?

The word encroachment is a very strong word to describe the role of Judiciary in the country.I think the Judiciary is staying within its limits and carrying out its responsibilites very effectively.The word encroachment perhaps can be attributed to the Executive which has faced a brunt in lot of recent judgements.As per the Indian Constituion the Executive is entitled to bring in a Bill and come out with Laws for the country , but it is the duty of the Judiciary to interpret those laws and make amendments if needed.The recent judeegment given by the Apex court in the Jharkand Assembly where the Center had placed the Congress govt in the state citing hoarding of MLA s , MLA s being traded.....the SUpreme Court stepped in and reminded the powers of the Goverener.It said that no law prevents MLA s to switch Parties and earning money in the process.This is defined in the constitution. I wont term it as encroachment ....all it is doin it is carryin out its goals.....

I think this topic d never have cropped up......but the recent rulings agains a lot of sitting MPs have cause them to press the Panic button.......Otherwise evthing s normal...

Sorry to just prompt your discussion but i see it the other way round.....
While creating our constitution although each and every field was assigned an independent job and task to perform ... they are actually interconnected and there are situations where in there is a role of the other in some others foot.

The judicial system has to come into picture where there is mismanagement in the other two .... so that the clashes get resolved ... while the Legislature is by the people and for the people ..... it plays a role for the peoples benefit and has to rule and regulate the executive works..... as well the executive has to take into account the legislative and judicial constratints for its work ....

so how can it be that an entirebody with different organs works independently without one affecting or regulating the other.......its just a chain to achieve perfection so that one can regulate the other from malfunctioning....

i would like to know if the others disagree to this view

To my earlier discussion i had put forward - an excellent example of it is the SEBI which is a combinaition of all the three bodies into one main body ...... although confined to an arena....but the same can be seen on a broader picture.......

in my point ppl can be active here as well if they can put in some contribution instead of just saying tht the thread is a bit low in participation.....

ok, this thread seems to have been inactive from some time....

So with the GDs on.... we have sprung into action and brought back 'Online GD'

You need to register on onlinegd : Online GD to enjoy the benefits
