okay.. I think the previous topic got a fair deal lets look into another , its rather not looking good for those above 60 in India ,Do Senior Citizens in India need special treatment in all walks of life

hey thanx for the guidance, as global warming is also a burning issue,as ipcc recently shared its nobel prize with Al gore.and also discussion on kyoto protocol is imp.

Climate change will impact everything from food and water security to national and business interests. The role of Judicial Activism in India today

Definition:

Judicial activism is the term used to describe the actions of judges who go beyond their constitutionally prescribed duties of applying law to the facts of individual cases, and "legislate" from the bench. These judges create new constitutional rights, amend existing ones, or create or amend existing legislation to fit their own notions of societal needs.



*Judicial activism was made possible in India, thanks to PIL (Public Interest Litigation).Under the Indian Constitution, the Supreme Court and high courts can be approached in case of a violation of fundamental rights.


* The Indian Government proved its inability to effectively tackle the problems of the underprivileged strata of society and, in response, the judiciary, leaving behind its traditional moderate role has adopted a more active role.

*In the beginning, the application of PIL was confined only to improving the lot of the disadvantaged sections of the society who by reason of their poverty and ignorance were not in a position to seek justice from the courts and, therefore, any member of the public was permitted to maintain an application for appropriate directions.

* The court then entertained a number of representative petitions in the areas of custodial death, prisoners’ rights, abolition of bonded labour, condition of mental homes, workers’ rights, occupational health and related issues. The rationale was that fundamental rights remained on paper for a large number of marginalised sections of society that were not in any position to come to court. Therefore, public-spirited persons could file petitions on behalf of these poor and exploited classes of people.


*Gradually, however, the court began entertaining public interest petitions that were not solely on behalf of the exploited sections. Some of the petitions dealt with social ills like corruption and the criminalisation of politics. River pollution, destruction of forests, waste management and environmental conservation began to constitute another huge chunk of PILs.


* People turned to the judiciary as a panacea for all ills, and the courts seem to have accepted their own omnipotence. Cases like the hawala, Bofors and fodder scam are all household names today.


*Today, PIL is an ever-expanding universe. Any and everything, from the selection of the cricket team to the construction of a flyover, falls within its domain.


* A large number of funded and non-funded CSOs, in the shape of committees, centres and human rights networks with the primary objective of filing PILs, have mushroomed.


* From the PIL’s humble beginnings as champion of the poor and exploited, public interest litigation is moving in a diametrically opposite direction; There was a time when the courts would provide relief from the harsh, arbitrary actions of the executive, reflected in, say, the grant of a stay on the demolition of slums on grounds of lack of a rehabilitation plan or hardship of the monsoons, or school examinations. Today, slum demolitions are being directed on orders from the courts. Today, it’s the executive and legislature that are trying to put a relief and rehabilitation scheme in place before such demolitions. The courts, on the other hand, are declaring that demolitions should be carried out immediately, rendering scores of people homeless.


*PIL’s today are grossly misused; Someone finds Sachin Tendulkar guilty of defamation of the National tri-colour by cutting a tri-coloured cake, while another finds it an insult to the national flag when Sania Mirza sits, with her leg pointing towards it and this becomes a reason to file a PIL, leaving genuine cases pending.

lets talk abt this topic today
Sons of soil issue that came up with raj thakery

lets talk about its pros and cons....
and let this be the topic for 12th march....pls dont post any other topic

My take on this issue....
  • recent controversy of raj thakery going against ppl from bihar living in maharashtra was solely based on playing dirty communal politics..
  • we also saw actors like nana patekar joining force with raj thakery
  • this has led ppl from bihar to flee from maharashtra bec of fear of attacks in such communalistic environment
  • these ppl mainly included workers employed in making buildings...as a result there was a slowdown in the realestate in pune as reported by a newspaper...as there were no workers for completing the unfinished work
  • in this era of globalization and liberalization talking on such conservative lines is really bad this will certainly affect the harmony in the maharashtra state itself ...it is like sowing the seeds of mistrust in ppl
  • bombay has already seen the worst in the riots of 1992....it is best to learn from past.

Sons of soil issue that came up with raj thakery
1. The very concept is being made localized to all the
different regions in India. It is not only evident in Maharashtra but has been silently spreading in the North East as well.
2. India being a land of diverse culture, is always susceptible to such struggles due to selfish interest of some people.
3. It is sad to notice that the diverse culture which is the " melting pot of different cultures" is being made to look so.
4. People from sates which are less industrialised need to move to other industrialised states in order to earn livelihood.
5. It is the duty of the state to nip such feelings in the bud, other wise the only possibility on anvil is "Disintegration"
6. When the world is talking about India being a major driver of the World Economy, such parochial approach will not only deprive the indians but the whole world from the prospect of a new world power.
