Judged by higher standards

Summary:
· There aren’t any separate laws for judges.
· They are and should be subjected to the common law.
· The proposition of passing a National judicial council bill (NJCB)is a grt development.
· Some propose that there should be a NJC exclusively for the appointment of the judges.
· Though the writer agrees with this, he has made some recommendations.
· These recommendations are based on the experience of certain developed countries where this has worked.
· Opponents argue that if the judge is under the fear of committing misconduct during his proceedings, his judgement might be affected.
· There is also criticism regarding the possibility of the system not working in India.
· But the writer begs to differ, he is of the opinion that with our tradition of judicial impendence, this reforms would be a shot in the arm for judicial accountability.

Difficult words:
· Freemasonry: A natural or instinctive fellowship between people of similar interests

Checkout this article at this link: http://www.hindu.com/2006/03/20/stories/2006032004981100.htm

This was probably the most difficult article I read in the Hindu till now. I say this because it was very difficult to gauge the writer’s pulse in the first instance probably due to:
· Unfamiliarity with the subject
· Legal language
· Quotes and verdicts etc
It was by far the smallest article and I required two readings to prepare the summary and yet another to form my opinion.

MY opinion:
· The judiciary is one of the three pillars of democracy and its sanctity should be maintained at all costs.
· The author has given some prudent suggestions which have been accepted in Canada, NZ and Australia.
· I am not sure what’s the idea behind appointing a lay person apart from the fact that it’s been successful in other countries when they did so.

Someone please explain the meaning of “ratcheting” in this sentence:

It is ironic that this ratcheting up to a higher growth trajectory should have come at a time when reforms in the conventional sense seem to have reached a plateau, lending a new twist to the Indian growth debate.
here ratcheting up means to cause to increase in increments...
here the sentence can be rephrased like "it is ironic that the growth rate increasing in increments to follow a higher growth trajectory.................."

Hope ths clrs ur doubt

According to me Ratcheting means advancing in a particular direction.

With whatever sources i cud lay my hands on, i feel that Ratchet and Rachet mean the same when used as a noun i.e. a Mechanical device consisting of a toothed wheel or rack engaged with a pawl that permits it to move in only one direction.

But when it is used a verb, it can only be ratcheting which means to move in a particular direction.

Plz correct me if i am wrong.

Supreme Court judgment revisited

Summary:

· The article describes the goof up in the proclamation of the president’s rule in Bihar.
· The writer holds responsible the following persons for the mishap.
o The Governor of Bihar
o The PM and the Cabinet
o The President &
o The Supreme court
· This encompasses all the governing institutions of India.
· He explains elaborately the way in which justice was mocked at every stage.

Difficult words:

· Indictment: n. 1 a indicting, accusation. b document containing this. 2 thing that serves to condemn or censure (an indictment of society).
· Horse-trading: Negotiation accompanied by mutual concessions and shrewd bargaining
· Defection: Withdrawing support or help despite allegiance or responsibility

My opinion:

· This is an eye opener for people who are at the helm of the affairs in India.
· If strong political parties that too in Bihar couldn’t prevent the assault at various levels in the so called largest democracy in the world, the plight of the common man is can’t really be imagined.
