My thoughts:
2) Working openly and free of party prejudices, the american system, with all it faults, has its bureaucracy and judiciary.

In my opinion, both appear correct, but if you relate the meanings, there is a slight difference.
#2 says that:
american system is "Working openly and free of party prejudices"
american system "has its bureaucracy and judiciary".
#4 says that:
the american system "has its
bureaucracy and judiciary working openly and free of party prejudices". So the reference here is that "the bureaucracy and judiciary are working openly".
#4 made more sense since the meaning conveyed was that the judiciary (a law-making body) worked openly, immaterial of the party prejudices.
