For starters,
84 countries have abolished death penalty for all crimes.
12 for all but exceptional crimes like war time.
24 have abolished it in practise. ie, the law is there but not a single sentence has been given since atleast 10 years.
Your suggestion is that our over crowded jails cannot take in any more no. of prisoners and hence the hardened criminal should be given the death penalty. But isnt it better that we make the running of these jails economically viable rather than executing. Honestly, not even a small fraction of the total no. of jail inmates are executed every year.
So, making the running profitable is one solution. eg. The central jail at Baroda was in the news some 3 years ago, when it had for the first time not only broken even, but had managed to even make some money by selling various handicrafts made by the inmates.
Also, as far as i am concerned death penalty shouldnt be completely abolished for all crimes. Our constitution, has defined death penalty to be given in cases in rarest of rare circumstances. Its not like the States where annually a few hundredpeople are executed.
I know that people will say that death pemalty impostiton hasnot brought about the decline in crime rates. The major reason, i would say, for increase in crime rates is also that our population is increasing. Believe it or not, death penalty does serve as a detterent to some extent. I would just like the imposition to be slightly stricter. (Remove one or two special cases. I wouldnt want to name this special case.)
Also, i feel we should move towards a more humane form of death penalty. Hanging by rope is fine so long as the rope is of optimum length. Slightly shorter length and the person will have a slow torturing death. And if the free fall is slightly long, then the head and the neck region, just skim off. So, a move toward the lethal injection should be made, as is the case in USA.
