hi friends, i m juz curious abt the obc students who will be shortlisted in general cutoff, then whlie offering seat will they be considered as oba or open?? and such student can such student be considered in obc if he dnt make it thru gen category, as it is mensioned in cat bulletin tat category students will be treated differently. some1 please throw sm light on it. thanxx

In Ideal Case a OBC guy get less marks then Genral cutoff then his name come in OBC list other wise is is considered as a general student .... But What I experienced in Last Year JMET out of General merit list iits just seperated OBC people and kept them in OBC seat and the seats which got vacated by these OBC students went to general candidates . Please forget you are going to get any benefit because you come in OBC -non creamy . Just work hard ... even more harder then other guys because you have just 18 % seats to fight when more then 50% population of India come in OBC-Non Creamy(This is a Fact give in SC by GOI) .

Raising upper income limit for creamy layer to face SC scanner

The recent decision of the Union government to raise the income limit of creamy layer among the reserve categories from Rs 2.5lakh to Rs 4.5 lakh per year is likely to come under the Supreme Court scanner on October 14, when it will hear two applications, one filed by Union of India and another by Professor Indra Sen.

A bench comprising Chief Justice K G Balakrishnan and Justices Arijit Pasayat, C K Thakker, R V Raveendran and Dalveer Bhandari in their judgment dated April 10, 2008 had unanimously ruled that the creamy layer among OBC’s should be excluded from the benefit of 27 per cent reservation for OBC’s in admission to the Centrally-run educational institutions of higher studies.

The apex court had, however, upheld the validity of the government notification providing 27 per cent quota to OBC candidates in admission to educational institutions like IIMs, IITs and post-graduate medical science courses.

The court had, during the last hearing, also made it clear that seats which remain vacant de to non-availability of eligible OBC candidates must go to general category candidates.

In a recent decision, the Union government has also announced its decision that seats reserved for SC/ST candidates will not go to general category and shall remain vacant even if suitable SC/ST candidates were not available.

The decision of the government regarding SC/ST category candidates may not face any problem in the Supreme Court, if it remains confined only to SC/ST category.

But if the government tries to extend the same benefit to OBC candidates, then there is a possibility of confrontation between the government and the highest court of the land.

Anti-reservationists are likely to seek the intervention of the Supreme Court so far as the decision of the government raising the upper income limit for OBCs from Rs 2.5 to 4.5 lakhs is concerned.

They are likely to plead that this is an attempt by the government to nullify the orders of the apex court to exclude creamy layer from the benefits of quota policy.

wonder how will sc rules will help any really needy obc, if income slot is increased then compitition is high in obcs then rural student ie needy ppl will be out in competin all convent educated guys, i mean its whole concept of other backword class is out of view. its just politics thats it. anyway winner here will be open students cause they will claim on empty seats, and iims will not go below 10% of open cutoff fr obc. sometimes u cant help bt be cynical.

I agree with you on hard work.. not too sure abt creamy layer...I dont think creamy layer in OBC will get any benefit despite uplift in salary by govt..It is yet to be sanctioned and even if it is sanctioned, SC in all probability will not accept it...To quote SC verdict on 14th Oct, " let someone put petition against it and we will take cream out of creamy layer of OBC"...so not sure whether any OBC with income more than 2.5l will be benefitted at all...GC guys are only ones benefitted ...if OBC guys(18%) this yr are not able to clear cutoff( atleast 5 marks and atmost 10 below GC),then remaining seats of 18% goes to GC. Just because 18% reservation is there does not mean OBC will get all these seats..only option is work hard.

I hold contrary views. Even if 50% of the population comes under the non-creamy OBC category, more than 70% of the lot do not reach the graduation level. The seats allotted for the OBC category are bound to remain vacant and as such they would be eventually reverted to the general category. It's a good opportunity for people who fall under the non-creamy category to make it the elite institutes. But in any case, the percentage difference between the OBC category and the general category cannot go beyond 10 %. So one needs to get a competitive score.

The annual family income of 2.5L is too low a bar, that is set for 27% of the seats. That's a virtual sail for any candidate who falls in the OBC non-creamy layer. Off course he/she will have to meet the 10% criterion stated in the above posts; but anyone meeting the same is automatically assured a seat

Correct me if I am wrong, but it is my guess that a lot of the 18% OBC reserved seats will lie vacant (given the cut off criterion) and will only benefit the general category

I dont think 2.5 is too low to fill bt to maintain quality students, it has to be raised. nyway, 10% limit is not tat bad, i mean its percentages cutoff nt percentiles, so one can expect call with low percentiles say 94 or 90 in case of some iims. nyway friends halltickets r out. enjoy ur whole exp of cat. bye all the best n do well!!!
