Govt order for OBC quota challenged in HC Fri, May 2 08:29 PM
New Delhi, May 2 (PTI) An alumni association of IIMs today approached the Delhi High Court seeking to restrain the Centre from providing quota for OBC students in higher educational institutions, including in IIMs. The association contended that the government had misinterpreted the Supreme Court judgement, which while upholding the OBC reservation policy, had said that it would not be applicable to the higher educational institutions.
"The ratio of the constitution bench judgement is clear and it says that reservation is not available in Post-graduate courses," the association contended before a Bench comprising Justices T S Thakur and Siddharth Mirdul. The Bench after brief hearing sought the response of the Centre.
The government, however, sought some time to go through the judgement before responding to the contentions raised by the association. PTI. Yahoo! News - Not Found

Now this ONE...
HC stays OBC reservation in IIM-CalcuttaPress Trust Of India / Kolkata May 15, 2008, 0:19 ISTIn a jolt to the campaign for reservations for other backward classes (OBCs), the Calcutta High Court today stayed the implementation of OBC quota in post-graduate courses in Indian Institute of Management, Calcutta.
Justice Maharaj Sinha ordered the stay on a petition by Sayan Guha, a B-Tech student, challenging the human resource development (HRD) ministry's memorandum for implementing the quota. Interviews for the OBC seats are scheduled for tomorrow.
The interim order stayed till June 9 the operation of the reservation clause in the institute's prospectus as well as the resolution of the office memorandum, dated April 20, 2008, passed by the HRD ministry. The matter would come up for hearing on June 9.
Guha's counsels, Kishore Dutta and Nilava Bandopadhyay, told the court that the memorandum and the subsequent reservation clause were a violation of the April 10 Supreme Court order defining the creamy layer among OBCs that would not get the reservation benefit. They said while the Supreme Court had directed that graduates would not be considered for the benefit, the memorandum said all OBC students would be entitled to reservation in post-graduate courses.
No counsel appeared for the HRD ministry and IIM-C.
In a related development, the Delhi High Court issued a notice to the Centre on a petition challenging the implementation of 27 per cent quota for OBCs in IIMs and other central higher educational institutions.
A Bench headed by Justice TS Thakur sought the Centre's response on the petition within four weeks and posted the matter for hearing on July 10.
An alumni association of IIMs had approached the high court seeking to restrain the Centre from providing quota to OBC students in institutes of higher learning.
The association said the government misinterpreted the Supreme Court judgment upholding the OBC reservation policy which said the quota would not be applicable to higher educational institutions.
The petition, filed by the Pan-IIM Alumni Association, sought a stay on the HRD ministry's office memorandum, issued on April 20.
HRD Minister Arjun Singh said the Calcutta High Court order would not affect the implementation of the quota in other institutes of higher learning.
"The ministry will put forth its views before the high court. The stay may delay the quota implementation in IIM, Calcutta, but it will not affect the process in other institutions," Singh said.

Latest on the issue: SC lifts stay, clears way for OBC admissions- Hindustan Times SC lifts stay, clears way for OBC admissions
Admission of OBC candidates to post-graduate courses in IIMs and IITs can now resume. The Supreme Court on Friday vacated a stay order of the Calcutta High Court on implementation of the 27 per cent OBC quota in central educational institutions.
A bench headed by Chief Justice KG Balakrishnan also stayed all proceedings pending in the HCs in Kolkata, Delhi and Mumbai on petitions filed by anti-quota groups and individuals.
Terming the Calcutta HC’s interim order on Wednesday as “strange”, the bench said: “No court can sit over a Supreme Court judgment… We cannot allow the Calcutta High Court order to operate.” It emphasised that SC had already upheld the validity of the quota law, so there was no question of a stay.
The court also issued notices to Youth for Equality, Pan-IIM Alumni Association and Sayan Guha, on whose petitions proceedings were initiated in the HCs. They were asked to respond to the Centre’s petition seeking transfer of the cases pending in the three HCs.
The court did not agree with the argument of anti-quota groups that graduates should be treated as creamy layer, which was excluded by the five-judge Constitution bench that upheld the quota law on April 10.
Lawyers of the anti-quota groups pointed out that three judges in the Constitution bench had held that a graduate couldn’t be said to be educationally backward.
The court, however, said that admissions under OBC quota would be subject to the final outcome of the proceedings before the court.

IIM-C awaits Govt. direction for OBC student admission
Kolkata (PTI): The Indian Institute of Management, Calcutta (IIM-C) was waiting for a directive from HRD ministry to go ahead with the admission of nine OBC students in PG courses from this year after the Supreme Court on Friday lifted the stay on the process by the Calcutta High Court.
"We have come to know about the Supreme Court order but we are waiting for a formal direction from the HRD ministry to complete the process," IIM-C chief administrative officer Dinesh Verma told PTI.
Verma said IIM-C would complete the admission procedure so that OBC students could begin first year classes from June 23 as scheduled.
IIM-C has already interviewed OBC students for admission. However, to complete the process within the deadline the timeframe for acceptance of the admission offer letter would be shorter than the three weeks allowed in the normal course. IIM-C issues offer letters to OBCs
Kolkata: Amid strong protests against the quota reservation policy of the government, the Indian Institute of Management (IIM), Calcutta is all set to release its admission offer letters to Other Backward Classes (OBCs) candidates.
On May 14th, the Calcutta High Court had stayed the admission of OBC candidates in higher institutions. Thereafter, the Supreme Court permitted all higher education institutes to go ahead with their admission process.
IIM-C conducted a round of group discussions and personal interviews on May 15th. The final list was delayed seeking approval from the Ministry of Human Resources Development (MHRD).
Mr. Dinesh Verma, the Chief Administrative officer of IIM-C, said that, "The Ministry of Human Resource Development has attached a copy of the Supreme Court ruling with the official letter and asked the institute to proceed with its upcoming admission process."
Officials at the institute have also said that the offer letters are 'Provisional' as no specific instructions have come from the HRD Ministry.
Candidates, to whom the offer letters have been issued, have also been asked to sign an undertaking that their admissions would be terminated if any legal complications arise in near future.
