every Central Educational Institution shall, with
the prior approval of the appropriate authority, increase
the number of seats in a branch of study or faculty over
and above its annual permitted strength so that the
number of seats, excluding those reserved for the
persons belonging to the Scheduled Castes, the
Scheduled Tribes and the Other Backward Classes, is
not less than the number of such seats available for the
academic session immediately preceding the date of

Sorry for posting multiple posts..this indicates staggard implementation...so results will be out soon woithout delay as this things are already planned.
(2) Where, on a representation by any Central
Educational Institution, the Central Government, in
consultation with the appropriate authority, is satisfied
that for reasons of financial, physical or academic
limitations or in order to maintain the standards of
education, the annual permitted strength in any branch
of study or faculty of such institution cannot be
increased for the academic session following the
commencement of this Act, it may permit by notification
in the Official Gazette, such institution to increase the
annual permitted strength over a maximum period of
three years beginning with the academic session
following the commencement of this Act; and then, the
extent of reservation for the Other Backward Classes
as provided in clause (iii) of section 3 shall be limited
for that academic session in such manner that the
number of seats available to the Other Backward
Classes for each academic session are commensurate
with the increase in the permitted strength for each

According to me, these lines imply that they are only required to maintain the same number of seats as last year.( in the general category)

Kindly share your thoughts on this!!! | I myself personally know guys with calls under OBC reservations who converted calls last year ie except A (Which declared the minimum cutoff ) last year every other college absorbed the OBC candidates under general category...If this rule is extended, you never know the proportion of seats which would be eaten away..
But, there is one more thing here, many of the OBCs (including me) would have applied under General Quota after last year's experience..So the General Seats now would anyways have OBC guys applied under GC.
Now coming back to the Judgement, I would say it was a great Judgement as in it addresses the needy & has nailed the Govt's intention....Now, if this quota is used in a proper way, it will uplift lots of Middle Class Families...
The only irritating thing is the delay in the results, but finally the Verdict has to satisy every segment and the SC has done it in a very good way.
PS: IAM AN OBC (Creamy Layer) Success retained me as a boy, But Failure made me a MAN ORKUT ID

Kindly share your thoughts on this!!! | i dont think this is the right way to look at it, actually, if a candidate applying from a reserved category is eligible for admission under the same criteria as a general candidate then that person is offered a seat from the general seats only, and that basically vacates a seat in the reserved category for the underperforming (dont know of any better adjective here) reserved category student...
so basically any OBC who gets marks more than the lowest marks of a selected GEN candidate, will take a GEN seat only...
another thing, in a scenario, when they cant find enough people frm the category to fill up the seats, these seats are not offered to GEN category people...like there were only 20 ST students shortlisted for the 21 seats that are there for the taking at IIMA!!!!
but ya, 6 seats have increased in IIMA for GEN...in the short term...but the impact is much more than that...
IIMs basically are a point of contention here for the salaries that people draw after graduating from an IIM...a part of which all categories want to enjoy...so reservations put into place...but that in response makes the industry feel that the reservations will dilute the level of students...so as a response, IIM students lose out on reputation...
and an institute having half the students who are generally not equally capable in their intelligence (or whatever CAT mite be testing) would certainly be perceived differently from the way it is looked as now...
anywayz, the latest important news now is that the declaration of results has been postponed by another week, as mentioned on the respective websites...
so people just go out and relax...come back after a week...
and we shall all meet here and discuss the results

IIM's Don't Come Under Reservation Harish Salve, lawyer for the doctors' association, who are against reservation in higher studies, told rediff.com, "I am quite happy with the judgment. This is one of the most balanced judgments".
He emphasised that, "Indian Institute of Management is a centre of post-graduate studies and the judges have accepted our argument and have exempted the application of reservation in post-graduation studies". Salve said that, "Indian Institute of Technology may have the reservation for OBCs".
Elaborating on the reason behind his satisfaction with the judgment, Salve said, "We had been arguing on a number of issues. We wanted to bar the creamy layer from benefiting from the reservation. The Supreme Court has accepted our argument. We were arguing for the fresh identification of castes. The judges have agreed to do it as well. Because of the today's judgment, it will not be affordable for OBC students to avail the quota because of the criteria of creamy layer and fresh identification of castes".
