Hi Everyone,
I went through the entire document of the Supreme Court Verdict..
Wanted to put light on the following categories which are in the creamy layer or have been excluded from reservation "IV. PROFESSIONAL CLASS AND THOSE ENGAGED IN TRADE AND INDUSTRY (i) Persons engaged in profession as a doctor, lawyer, chartered accountant, income Tax consultant, financial or management consultant, dental surgeon, engineer, architect, computer specialist, film artists and other film professional, author, playwright, sports persons, sports professional, media professional or any other vocations of like status. (ii) Persons engaged in trade, business and industry. " I guess that puts almost all the OBCs who apply for CAT out of the resevations. Because as much i know more than 95% people applying for CAT are engineers or doctors or commerce grads." And after removing these guys and add to the fact that the cutoff for OBCs cannot go below 90% of the general, I don't think they will find any body eligible for the reservations." Alos wealth wise anobody whose income is above the tax exemptions(ie 250000) is not eligble, but couldn't find anywhere that graduates are creamy layer. So I feel the OBC quota is applicable to IIMs. Regards There are 10 kinds of people in this world- those who can understand binary and those who can't. Can sombody explain what this means.
This is the only extract in the entire document referring to graduate or post graduate courses. "The learned Senior Counsel also contended that the contention of the Petitioners that special provisions can only be made up to 10+2 stage is untenable. If this plea is accepted, it would result in higher education being the privilege of the higher classes only and it would be a distortion of the concept of social advancement of the downtrodden and the negation of the goal envisaged by the Preamble. It was also contended that the principle of reverse discrimination is not applicable. The Doctrine of Strict Scrutiny and Narrow Tailoring are not applicable in India as they are American doctrines which operate under different facts and circumstances. This court on earlier occasion had rejected these pleas, when dealing with admission to Post-graduate Medical Courses, when 75% of seats were being reserved on the basis of institutional preference. Final year students/ Unemployed grads are then going to be scrutinised according to their parents vocation/income.
But i guess even they will fall under the class of engineers or doctors or finance professionals etc... Am not clear on that. Document is tooo generic and doesn't talk very specific.
So i guess lot of people will qualify here.

You may argue GC students may have contained OBCs as well, which makes the issue complicated, and hence the institutes cant come out with a list only with GC students for now. Its quite a substantial number we are talking abt here - so to say GC students will remain unaffected, is a mere hogwash. Similarly for lucknow, which had announced an increase from 250 to 300.
