I do not think that would be the case....consider this.....If IIMs are not giving calls to OBC candidates and if quota is to be implemented this year...then they have to give seperate calls to OBC candidates again and they have to conduct GD/PIs again.......rather they would just pick some 70-80 OBC candidates now itself so that if the quota is implemented then they would be given final call letters else they would be ignored....

Buddy, the matter is subjudice before the Apex Court. It had already, in its interim judgment, stayed the implementation of the impugned Act. Issuing Call letters to OBC candidates under OBC category would amount to contempt of court for disobeying its orders.... If the IIMs issue such letters, the Apex Court would pull up the institutes by sending a notice to the IIMs asking why should it not take action against the institutes for disobeying its interim judgment.....

Buddy, these are legal wrangles.. I hear about them from my parents on a regular basis..

Dude...the CAT bulletin clearly states that OBC reservation depends on official communication from MHRD and not from Apex court. centre would have given some communication to the IIMs as the elections are near-by and they dont want to give NDA the advantage of OBC-quota issue. The Centre would bring in an amendment or something of that sort which can prevent judiciary to take any action against the quota. still there is a good four months gap for this to happen....And in all likelihood this matter will come into picture once IIT-JEE fever kicks in. With the election results in Guj and HP not favouring UPA, it would try to satisfy the OBCs with this. Also the last time around Centre tried to pacify the apex court to the maximum extent possible. And the Apex court has never ruled out the quota implementation but has just asked the centre to verify the percentage of OBCs and then put forward the percentage of reservation to be given. So if the centre agrees to exclude the Creamy layer or comes up with a little lesser percentage (say 17%) then there is a very high probability that the Apex court would lift the stay.

I never said that OBC quota will/wont come in this academic session. What I said was, at this juncture, the IIMs cannot issue any call letters to candidates under OBC category because the matter is subjudice before the court. If need be, they would do so at a later stage when the issue is sorted out. And regarding your statement 'Centre would have given some communication to the IIMs ....', Centre isnt above the law. So as of now there is no OBC reservation.

But yes, by the time the IIMs' admission process is done with, there are high chances of the quota to kick in. So if you belong to OBC category, or any of your friends do, you have reasons to cheer... But take it from me, there wouldnt be any OBC shortlists on January 8....

i think ur right. the govt will kick start this issue only when there is going to be little time for implementation.

There is no point in being happy or unhappy about this. There are people who need reservations, let them get it....would be happy if the Cramy layer is excluded......
