They have given 8 weeks for this hearing, now the SC has holiday for 7 weeks starting from 19th May.

If the court sites for this hearing also.....will they take full 8 weeks to descide?????

If my understanding goes right, its the maximum time frame the hearing can go on....In the sense, the parties can finish off with their arguments with in a day or till a maximum of 56 days..But, my gut feel, the petitioners will try to drag it for 56 days as, if they cannot stop the implementation from next year, atleast they will be happy to hold it for this year ...

There is a saying in Tamil & if I have to transalate it, the meaning would be "If I loose both of my eyes, the oponent should loose atleast one eye"...But unfortunately, instead of targeting the GoI's eye, they are targeting our eyes, a few thousands of eyes....

Whatever is the understanding....the question is what should we do now....how do we make our voices heard even to the GoI that we are suffering really badly. There has to be a way out of this mess for us....Please suggest friends.

No... Its not about the time frame of the hearing.... All the arguments related should be submitted to the court within 8 weeks... Now that the SC has reserved its verdict the date on which it would pronounce its decision for the matter to be referred to the constitutional bench is uncertain, but most likely it would be tomorrow...... and IT TAKES TIME for a constitution bench to be formed........ which would hear the questions framed by the counsels AFTER 8 weeks...... you may wait till tomorrow morning to get this confirmed....

But no other Paper or online channels mention about that 8 weeks period..Anybody watching TV, any updates???

This is what CNN has to say

New Delhi: The Supreme Court has reserved its order on the Centre's plea to refer to a Constitution bench the issue of 27 per cent quota for OBCs in institutions of higher education, like IIMs and IITs.

A Bench comprising Justices Arijit Pasayat and L S Panta asked Solicitor General G E Vahanvati and senior advocate Harish Salve to compile the various questions put forward by contesting parties.

This was asked to be done as there was overlapping of points in the questions. The questions would then be considered by the larger Bench.

On Tuesday, the Supreme Court had asked various parties related to the matter to formulate the contentious points of law and put them before the court by Wednesday.

The matter had been listed for hearing before a the Bench, which is incidentally, the same Bench that declined to lift the stay on the implementation of the quota on March 29.

The Bench in an interim order had stayed the implementation of the law from the 2007-2008 academic sessions and had dismissed the Centre's application seeking the modification.

Thereafter, the Central Government had requested the intervention of Chief Justice K G Balakrishnan and sought an early hearing in the case.

Balakrishnan accepted the Centre's request for early hearing, despite protests from the anti-quota lobby saying it was the CJ’s “prerogative and privilege to decide which matter was to be heard on priority”.

Meanwhile, after Railway Minister Lalu Prasad's RJD and UPA’s ally PMK came in support of the 27 per cent quota and filed an application seeking to plead in the case in support of the central government.

Agencies report that justifying the 1931 census as the basis for arriving at the 27 percent quota for OBCs, Tamil Nadu said "collection of caste-wise details was dispensed with after 1931 census.

The only source in which the details are available is the 1931 census and therefore there is no harm in adopting the population and other details available in the above census.

The Supreme Court has reserved its order on the Centre's plea to refer the issue of 27 per cent quota for OBCs in elite educational institutions like IIMs and IITs to a Constitution bench.

A Bench comprising Justices Arijit Pasayat and LS Panta asked Solicitor General GE Vahanvati and senior advocate Harish Salve to compile questions put forward by various contesting parties to be considered by the larger Bench.

The court said there is overlapping of points on the questions formulated by the contesting parties.

The Solicitor General and Salve will sit together to make a compilation of it and place it before the court on Thursday

Order reserved on referring quota issue to constitution bench

The Supreme Court Wednesday reserved its order on the union government's plea to refer the issue of quotas for other backward classes (OBC) in centrally funded higher educational institutions to a constitution bench.
The order on assigning the task of examining the legality of the law reserving 27 percent seats for OBC students to a constitution bench was reserved by a bench of Justices Arijit Pasayat and L.S. Panta.
It did so after giving a cursory glance to several sets of questions, formulated by various contesting parties for examination by a larger constitution bench.
The bench forwarded those questions to Solicitor General G.E. Vahanvati and senior counsel Harish Salve for compiling in proper format and to avoid repetition.
The judges said there were several overlapping and common questions drafted by the contesting parties and Vahanvati and Salve would sit together to compile them and submit them to the court Thursday.
The bench also gave eight weeks time to the contesting parties to complete their pleadings on the issue of the constitutional validity of the 93rd Amendment Act and the Central Educational Institution (Reservation in Admission) Act 2006 - that provides for the quotas.
Observing that the questions drafted were indisputably important and of far reaching consequence, the bench said various issues had been formulated by the counsels and it was desirable to consider them before referring the matter to a larger bench.
The court said since all states have been made party to the petition, it would not allow individuals and organisations to be impleaded as parties. However, it allowed recognised political parties like Lalu Prasad's Rashtriya Janata Dal to be heard during the arguments.

Hey friends

Our own two champions of OBC reservation, Mr. Laloo Prasad Yadav and Karunanidhi are stuck with their own party and personal problems and receiving flak in the parliament for the same. Laloo's RJD member and his right man Shahbudding has been sentenced for life for murder and other cases. Karunanidhid's elder sons supporters burnt down a newspaper office in Tamil Nadu killing 3 people. So it is bad news on all the fronts. And the court isn't being considerate to any of the pleas by GoI.

So guys relax and try to involve yourself in other constructive things. My personal suggestion would be take up a good job or if you feel stuck with an old job make a switch. It will get you some fresh air and peace of mind. Also start preparing for CAT 2007. Time test series are starting from May 27. If we could clear it this time, with little more dedication and effort we can clear it next time too(with or without reservation).

How much ever we may think and savour the hope....it is time to move on in life. May be it was a lesson life was supposed to teach us. Let us keep in touch and motivate each other to achieve greater heights. All the best guys and stop attaching so much attachment to the proceedings of the case because it will eat you up and the wait can be unnerving. We can start a new thread and start sharing material and do some preparation or mativational discussions there. It is time to bid adieu to this thread.

Cheer up guys and move on....we deserve better and we shall have it.

Hello !

I am not a OBC. But I am a general category candidate ( rather, was ), who is appalled by the way things are going for you guys.

This is unsolicited advice....... and you can groan at me for that..... but guys, move on. Believe me, there's NOTHING you'll gain by constantly watching out for news, being on the edge always, waiting, hoping, expecting. In the end, if things dont work out, you'll collapse....

I had 5 IIM calls...... and i havent converted ANY of them except for a IIM I w/l. For more than a week after the results, I kept refreshing PG constantly everyday for some scrap of info which might give me hope. For a week I couldnt cope with the shock, the overwhelming feeling of defeat and helplessness. Then, I got to my IIM I w/l number......... it was a pathetic 400+........ i felt terrible for a day or 2, but then suddenly snapped out of it. I still have relapses, but I am much better....

Till you keep hoping, you will increase the chances of plunging further into depression and gloom if things dont work out. the moment you let go, it all becomes much easier.

Accept things as part of fate........... sometimes things dont work out even when its not your fault. atleast i didnt make it because i didnt deserve to... you guys didnt because of no fault of yours.... you can stand tall and tell that to yourself.

Look at prem_ravi...... he's the perfect example of this...... he's accepted reality and moved on.... he's being practical about the whole thing and not keeping any hopes. This dude is an amazing chap..... I wish i could be so positive about things...

All the best to you guys......

Harshad
