I need information regarding below points:
1. I have broken H1B visa Bpond of 5 Lacs, which signed by my previous employer and now after coming to US shifted to other company.
2. After sending e-mails and absconding letter, company sent legal high court noitce, so want to know how serious it is.
3. Is they can take any valid action further, as I am in US.
4. How to come out of this situation, as company has sent legal notice to Indian res. address.
You should really be consulting an immigration lawyer now. This is serious stuff. I suggest you try to talk to your previous company and agree on an out-of-court settlement.
You can't wait for inspiration. You have to go after it with a club
I think US immigration consultants will not know anything as in US bonded labor is illegal. My suggestion would be to contact your fellow collegues who were in the same situation. You could also contact some Indian lawyers and see how strong of a case it could become.
My bet is if you are in US, nothing can happen. But things might change once you reach India.
Here's what I think -- you are not asking the right people.
This is a legal complication, and may turn into an immigration complication (I am not a lawyer, so I don't know for sure). As is the case, most people on this forum are not lawyers, and even they are, you shouldn't base such decisions on online advice.
What you could do right now:
1. Consult a legal expert in India. You may ask around in your friend circle if they or their friends have any relative or acquaintance who has legal expertise to advise on this matter. Ask them in detail about what is the extent things can go wrong if unattended.
2. Consult an immigration expert in US, to see what implication such a civil notice can have on your future immigration possibilities there (or even to other countries like UK. Don't just think US.)
3. Of course, you have violated a legal bond, and the most appropriate course of action is to pay up wherever due. You could think on how you can set matters straight by asking your new company if they can offer to pay your bond dues (even as a loan, if that's what they want) in the meantime.
Yeah They Are All Right.we Dont Know Much About The Nuances Of Law Especially Those Concerning Usa Immigration.the Best Person To Ask Would Be A Lawyer Based There For An Off Court Agreement.
