Counsel for Petitioner :- Alok Mishra,Abhishek Mishra Counsel for Respondent :- C.S.C.,Ayank Mishra Hon'ble Vikram Nath,J. Hon'ble Daya Shankar Tripathi,J. Heard learned counsel for the petitioners, Sri Anurag Khanna, senior advocate assisted by Sri Ayank Mishra for respondent nos. 2 and 3 and Sri Abhishek Srivastava, advocate, who has filed an intervention application on behalf of 14 selected candidates. The application will be got registered through the computer section. On 20th January, 2017, the following order was passed:- "Heard learned counsel for the petitioners, learned Standing Counsel for the State-respondents and Sri Ayank Mishra, learned counsel representing respondent Nos. 2 and 3. According to the learned counsel for the petitioner out of 150 Multiple Choice Questions (MCQs), 30 answers as indicated by the respondent examining authority were incorrect to which objections were filed by the petitioner. The respondent examining body corrected their answer in respect to 11 questions, however the objections with regard to remaining 19 questions were not accepted by the respondent examining body. This resulted into material irregularity in the examination process. Learned counsel for the petitioner further submits that evaluation on the basis of incorrect answers materially affects the results of the selected and the unselected candidates. Sri Ayank Mishra, learned counsel for the respondent may obtain instructions with regard to the averments contained in the petition within a week. Put up this case in the additional cause-list on 31st January, 2017." In the counter affidavit filed today, it has been stated in paragraph 21 that the Electricity Services Commission, the examining body, has already sought second opinion in regard to the disputed questions. The expert opinion would be available within two weeks. Dependant upon the same, the examining body would be taking a fresh decision in the matter. We, accordingly, direct that this matter may come up in the additional cause list on 27th February, 2017 showing the name of Sri Abhishek Srivastava, advocate from the side of respondents.
