Hon'ble CAT has given its judgement in favour of petitioners considering their mistake as not grave as same was upheld by HC. It is obligatory for CAT to follow HC judgement. Actually, SSC has erred by not challenging previous chsl/HC judgement in Supreme Court. CAT has given SSC 3 months time period to include petitioners in merit list as per merit and now Ball is in SSC's court to decide whether to have separate list for them or to revise the whole result after consultation with the departments if they r ready for additional nomination. But, SSC advocate has suggested them to consider all such candidates as per merit. SSC will decide whether to include them or challenge the judgement in HC. Finally, stay vacated and dossier sending allowed. It is high probability that separate list is made but if departments object to it, SSC has no option but to revise the result. Result revision will further delay the joining process and further litigation. Stay tuned for more details.
