Standing firm by its March 17 judgment on removing Jat community from the Central list of Other Backward Classes, the Supreme Court, on Tuesday, refused relief to a group of medical students caught midway between the examination and admission processes when the apex court pronounced the verdict.

On March 17, this year, a bench led by Justice Ranjan Gogoi quashed a March 4, 2014 notification issued by the UPA government including the Jat community in the Central OBC list.

The students had moved the Supreme Court last week seeking clarification on their fate - that is of those who had already applied for admission under the OBC category prior to the judgment.

They contended that future of students like them, who appeared in All India Post Graduate Dental Entrance Examination (AIPGDEE) 2015 and All India Post Graduate Medical Entrance Examination (AIPGMEE) 2015 and secured ranks in OBC category has now become uncertain.

The students pointed out that different institutions, including the Delhi University, had drawn fresh lists of candidates post the March 17 verdict. They said, now, they are being considered under the General Category.

"The candidates are bound to suffer heavy losses in the form of an academic year, time and resources, if the said judgment is allowed to apply to candidates who are in a transitory phase in the process of completing admission and enrollment," their application said.

However, a Bench of Justices Ranjan Gogoi and Rohinton Fali Nariman, dismissed their contentions, while observing that "no vested rights could be created" in their favour post the judgment.

Justice Gogoi, who authored the March 17 judgment, however observed that admissions made under the Jat quota prior to the date of judgment would remain effective as their rights have been "crystallised".

With the case filed by the doctors for the PG exams and courses and the SC verdict on it, we can't simply jump to the conclusion that Jats will be considered as General. That's because of a couple of points

First and foremost, the wording in the CAT advertisement is very clear about the OBC status and how it would apply to those castes that are a part of it on 30th September. 

Second, when he judgement came out last year, IIMs didn't consider Jats as OBC whereas he doctors were considered as OBCs  that's because the admission process is very different for CAT and Medical PG courses, which don't have any interview. In my opinion if IIMs have to apply the judgement, then those that got admission last year in PG courses as Jat OBCs should also be asked to reapply  

third, a very important part of the admission process has been completed, which is the interviews. Medical entrance has no interviews and is only dependent upon the entrance exam. In the case of UPSC, I don't think what is applied to UPSC candidates would apply to IIM candidates because UpSC hasn't done their interviews. 

if IIMs have to consider Jats as general, it would become easier for the other OBC and unfair to the general candidates.

IIFT , I agree didn't consider Jats as OBC, but that's also because they don't have anything written about the deadline for consideration of OBCs, unlike CAT. If we look at it, whereas DU medical considered Jats as general, FMS gave out calls to Jats as OBCs. Moreover, MFC(DU) gave out shortlist, interviews and results, all after the SC verdict of 17th March. Same universities can't have two different yardsticks, unless it's legacy explainable, which the CAT notification takes care of.

Ofcourse these are all speculations, but I think these are logically backed and possible and probable, and moreover what I consider to be fair and right.

THE REAL REASON FOR JATS CONSIDERED GENERAL:

I had  a discussion with a family friend who is a lawyer

1.Even if someone converts and the college gives admission to a JAT under obc, The college mandates that a fresh NC-OBC certificate issued after 1st of APRIL which is valid for the year 2015-2016 be produced along with other documents ,which the candidate will  not be able to show for as the authorities have stopped issuing OBC certificates for JATS  ,thats why IIFT has considered JATS as general.This rule is followed by all colleges giving OBC reservation .

2.The clause in the CAT form about "no changes after 30th Sept in central list will come into effect" ,is for inclusions in the list.That is  why when JATS were granted OBC status in March,they were not given reservation last year.There is no precedence in the past where a particular community is removed from the OBC list .Besides the lawyer said that the point 1 supersedes point 2 and hence will not be admissible in court.

These are the 2 main reasons for JATS being considered general.

I m confused whether a new list for PI will be released after SC quashing the JAT reservation or not ???

I am forced to resign from my company as I have finished my business wait limit, I have two months notice period after resignations. Keeping in mind the admission shortlists realessing next month, I am not sure what to do.

Jat students, who have appeared in various entrance examinations under OBC category and are waiting for the results will not get reservation benefit, the Supreme Court said on Tuesday.

The Centre on Wednesday moved the Supreme Court, asking it to reconsider its verdict that had scrapped the March 2014 notification to include Jats in the central list of the Other Backward Classes (OBC) category in nine states.

Frnds plz clarify my doubt....

I m jat by caste and my dob is 02 aug 1984. I was having obc certificate and applied for nabard grade a and grade b recruitment as obc cadidate. For general candidates age limit was thirty years but got relaxation of three years under obc category. I have cleared phase 1 and got call letter for phase 2 scheduled on 11 and 12 april 2015. Now recently supreme court has scraped jat reservation. Though i am sure that i will be considered as general candidate for phase 2 result but my doubt is that am i even eligible for recruitment as i m 31 years old.

review petition filed by government in SC  on wed for JAT issue. Could anybody provide the expected date of  hearing for this petition?

Will results of iims be delayed bcoz of jat reservation issue.... Let's hope results come on time without jeopardizing the future of our jat frnds..

Some facts about the Jat reservation issue

1. The petition filed by centre is at best a farce. It's a reconsideration petition and most of them are rejected. They made absolutely no changes to their arguments, just filed back saying, "hey you just gave this judgement, would you look at our faces once and reconsider?" The Modi govt. is trying to fool us. :( 

2. The recent judgement about the students of a certain medical exam was against them because, in their form itself it was mentioned that the result will depend upon SC judgement. But in the CAT form it is clearly mentioned that no changes hereafter will have an affect.

So my guess is we stand a chance but the govt. should be ashamed of itself. What crass abuse of its powers. Khak ache din. Resisiting the urge to swear here.
