For people who have chosen option 1 (like me) as they are not sure of settlement of the whole process (stay, litigation), they can take the exam in dec 07. But in that case cfa institute will be refuding only enrollment fees i think.
I stopped studying after sending option 1 as my choice. If exam were to happen on jun3 and all be required to take it, then i would have lost 3 days . :(

I just called up CFA hotline number here is update i have recieved
- The three options which were given in the initial mail are NOT Binding
- If one needs to cancel/defer his exam one cud send a mail to [email protected]
- The lady over the phone asked to maintain some patience as they are recieving over 2500 mails per day and all queries would be settled in a day or two
- if one cancels the exam at this stage one would get refunded in my case its around $850 as i had booked and as i had decided to cancel my exam

Im tempted to write a looong post venting my frustration, but i think its time for practical thinking rather than rhetoric. Some floating thoughts:
1. One thing's clear: the exam will NOT be postponed or cancelled under any circumstances. Absolutely no frikkin chance. Period. If the exam is postponed globally, not only will CFAI suffer huge losses, but also this issue will blow up from being an isolated incident in a third world country with crap laws to being a global black mark on the CFAI. The validity/existance of CFAI will be threatened coz tomorrow some ICFAI-equivalent crook "university" will crop up in Papua New Guinea (or some other country with an equally shitty legal system), follow the indian precedent, and hijack CFA brand there as well. (They could appoint ICFAI as their consultants for the project!)
2. Dont believe in or spread roumors and grapewine. This is the perfect timing for baseless "news" to crop out of nowhere. ("My friend told me that xyz is going to happen"). Trust only the CFAI official announcements.
3. If you HAVE TO take the L1 immediately, then go abroad and take the exam elsewhere. CFAI is giving you $300 (12K Rs) refund. Add another 8K and get on a flight. Effectively, you're losing 10K additional. Not bad.
4. If you dont intend to take L2 in june 08, or dont have any compelling reasons to take L1 immediately, then why not wait until Dec07? Chill. Revise, Revise, Revise. There will be some clarity by December and you'll also save a lotta money.
5. If you surely want to take the L2 in june 08, then taking L1 in Dec 2007 (whether in india or abroad) will not leave you sufficient time to prepare for L2. So if you want to take L2 in 2008, but cant go abroad immediately, then stop studying for L1 after june 3, assume you've passed, and start prep for the June 2008 L2. Revise L1 syllabus in Nov 2007, take L1 in Dec 2007, and pray your gamble pays off. It'll be pretty shitty if it doesnt, though.
5. If you HAVE TO go abroad immediately and cant find flights/hotels on your own, you could approach one of these holiday package ppl. Raj/SOTC/Thomas Cook and ask for their holiday packages to "Enchanting Nepal" or "Fabulous SriLanka" or "Mysterious Burma" (the irnoy is almost cruel!). They usually have bulk flight tickets readily available and give cool discounts on bulk bookings. Maybe 5-10 of you could negotiate a good deal...they'll be more than happy to have low-maintenance geeky tourists. FYI, 3-day package to Thailand (including flight, food, hotel, travel) can be negotiated for 20K if you have more than 5 ppl. You could drive down the price by saying you dont wanna visit the fancy beaches (or do you?
)
6. Dont worry so much about the costs immediately. If you clear L1, your new job/salary increment you will receive will offset the loss due to flights/hotels within a month or two. The ordeal you go thru to take the exam will only show your dedication/sincerity to your current/future employers, if nothing else. If you're a sponsored candidate, have your company pay for the trip. Go business class, in that case. 
7. If you just cant find a direct flight from mumbai/delhi to Nepal, then fly to Calcutta/ Lucknow/Darjeeling/someplace near the border, and look for flights/road transport from there to Nepal.
8. Think long term. Spending that additional money on the trip will also let you take the 2008 L2 in time. There's no frikkin way you can clear L2 in June 2008 if you do L1 in december 2007 (remember, results will come out only by end feb 2008.)
9. Dont waste your time sending campaign emails or emotional appeals to CFAI for help. (or abusive emails to ICFAI, for that matter
). If you have a doubt, call them up; if you dont, sit and study. The situation is complex and the last thing they'll do is to act on your suggestions/protests/campaigns.
10. There isnt much you can do about the situation. This isnt the end of life. So, Chill. Relax. Take a deep breath and pray that the universe conspires in your favour (And sucks ICFAI into that damn black hole, where it truly belongs
).

I think it's indirectly very clear that if exam is conducted in India, the candidates will not get any refund whatsoever except those 300 dollars for candidates who have appeared at other locations.

hey dude...thnkz for the link.but the date on the article on the site is 25'th may and in the last line of the article, it says "The matter will come up for hearing in the court tomorrow"
so would that mean today (25'th) or tomorow (26'th)...? waiting for even 24 hours in this situation is terribly unnerving !

my prep hasn't been good and not feeling confident enuf to crack the exam this time. there will be many like me who would like to defer / take the refund.
@ all: people trying for kathmandu location can take the flight from kolkata. it'll be cheaper. or u can also travel by road. the roads to kathmandu are good + the bus services are comfortable and easy to get the seats (not sure abt the summer season..)

Here's the response that I got: If you dont appear for CFA exam on june 03 (India or outside), in case if it were to happen, then you will be contacted regarding deferral or refund (if u cancel).
There's no need to send any mail (but there's no harm in sending one also) .
Have observed the whole scenario and a lot of posts on this thread.
Must commend the way this is being handled by the CFA institute.

Take a normal tourist visa ,for Thailand you can get visa on arrival ...

it is always safe to take expert advise from immigration consultant regarding visas to avoid landing in trouble. Better check with international travel agents.
