Citing the September 2015 order passed by the high court bench of Justice D.N. Patel and Justice Ratnakar Bhengra. Jha said prelims candidates were declared successful based on a short-listing policy where against each post, 15 candidates on an average would appear for mains. Now the question is why the people are protesting against the 1st list declared by jpsc which lead to 3years delay??? The reason is given below which must be understood by aspirants of jpsc- 1. The jharkhand paperII is for jharkhand candidates as most of the aspirants of jharkhand qualified for this exam. 2. If more number of seats are in general category, they have to apply to that category without taking reservation as they are free to choose general category. 3. This kind of examination ( classI and classII ) is open for all and they may apply to any state without having there said reserved category i.e, general category. 4. The reservation is provided in mains and interview so that they competes for their seats and if they get more marks they get the general seats against there category. ( To understand this let get an example- if obc get rank 1 in obc category but 150 rank in general category, then from obc category he or she would get ias rank but in general rank it would not be possible, this is the reason reservation is only applicable to mains examination and not in PT) 5. If reservation would be getting applicable in PT examination then it would getting very difficult for general candidate who resides in jharkhand as mul raiyat to fight with outsiders and with the reserved category in all three stages. This situation is called MULTIPLE BIAS. 6. This situation arose due to less seats of obc in 6th jpsc. As the notification and advertisement of jpsc says that only 15times of the seat of that particular category becomes qualified i.e., 12×15=180. This is the main reason for higher cutoff for obc category. 7. The rules and regulations guided by justice D.N. Patel and Justice Ratnakar Bhengra was applied in this examination for final cutoff for pt as it was applicable in 5th jpsc. So if there is protest in 6th jpsc for this by some "Nausikhiya neta", they would first protest for the cancellation of 5th jpsc. FOR YOUR KIND INFORMATION- THE EXAM IS NOT GOING TO BE CANCELLED BECAUSE FOR CANCELLATION THERE IS ONLY ONE CRETERIA i.e., MISAPPROPRIATION OR UNFAIR CONDUCT OF EXAM. This is only the matter of reservation marks so no way of cancellation of this exam. 8. The court is not giving its verdict in 6th jpsc because if this would happend then people will protest for the cancellation of 5th jpsc examination as this examination not followed the rules of reservation in pt. 9. The change in policy of reservation after conduction of pt, granting of revised results after taking pt exam is inappropriate and not with the rules as it is not possible to change rules in between the conduct of exam. ANY MODIFICATIONS IN RULES PERTAINING TO CONDUCT OF EXAM MUST BE FOLLOWED AFTER THE COMPLETION OF EXAM AND NOT IN BETWEEN. 10. This whole process regarding 6th jpsc will only delay the exam without any conclusions because- A. If govt make provision for 34000 is inappropriate B. If govt permit 6000 then also it will attract for roster making malpractice as defined in clause 4. C. There is no way to cancel this examination as there is no unfair conduct in examination. The only way to organise this examination with full adherence and dedication with 5138 candidates i.e, 1st list of PT of 6th jpsc or else it become burden for all as this will hamper more years to come. Note: As a lawyer if there is any change in the rule in between the conduct of exam, the court will have to definetly cancel the 5th jpsc or should adhere to 1st list of 6th jpsc or else everyone have to face trial even cm as the decision of 34000 is by their virtu.
