i dont think that there is any thing wrong in technical portion exam...and uppcl was doing very good thing by conducting non tech portion exam(as there was issue...)...but if the high court intervention will be able to stop uppcl to conduct nontech portion there will be deterrent effect on future recruitment in india as it will encourage people (who will not get good marks ) to always file writ petition against the exam and there will be delay in recruitment process ........and off course writ petitioner will get full support of 95% people as in all exam that much of people not able to got good marks to be in fight...... so i requesting all those people who r getting more than 110 marks in tech portion (definitely they deserve job right now) unite together and let file writ petition @supreme court for only non tech exam.......to save future recruitment in india from these type of deterrence... me 123 in tech comment ur marks with what step should be taken

An advertisement was published on 9 October 2016 for recruitment to the
post of Assistant Engineer (Trainee) for various disciplines. Selection was to be
made on the basis of a computer based test comprising of 200 questions out of
which 150 questions would be of Bachelor Engineering Level, 20 questions of
General Knowledge/Awareness, 20 questions of Reasoning and 10 questions of
General Hindi. The examination was to be held in two shifts in the following
manner:-

However, as number of applications had been received, the examination
could not be held in the pre-decided shifts and as there was no scope of centres
being booked at the eleventh hours, the schedule was changed in the following
manner:-

The paper was divided into Part-A and Part-B. Part- A consisted of 50
questions relating to General Knowledge/Awareness, Reasoning and General Hindi.
It transpires that the same set of 50 questions were set in the morning and evening
shift and when it came to the knowledge of the department that the candidates who
had appeared in the morning shift had leaked the paper to the candidates who had
appeared in the evening shift, it decided to cancel these 50 questions. A fresh
examination for these 50 questions contained in Part-A was ordered to the held. The
said examination, it is stated, is going to be held today.
Learned counsel for the petitioner has submitted that the decision of the
department to cancel only 50 questions out of the 200 questions is arbitrary and in
fact, the department should have cancelled the entire paper consisting of 200
questions that was held in the evening shift. To support the contention, learned
counsel submitted that no time limit was fixed for answering Part- A or Part- B and
therefore out of 200 questions that were required to be answered in 180 minutes, all
the candidates may not have devoted the same time to answer Part- A, which had
been cancelled.
Shri J.P. Pandey and Shri Ayank Mishra who have appeared for the
department, however, supported the decision of the corporation and have submitted
that since only 50 questions were leaked, the department was justified in ordering
the re-examination of these 50 questions only and there is no reason to hold the re-
examination of the remaining 150 questions.
We have considered the submissions advanced by learned counsel for the
parties.
It is not in dispute that the same set of 50 questions contained in Part-A
were asked from the candidates who had appeared in the morning shift and the
evening shift. The department having came to know that the same set of 50
questions which were asked in the morning shift were leaked, decided to cancel
only 50 questions. It is also not in dispute that no time limit was fixed for
answering Part- A and Part- B separately. In fact, the candidate had to answer 200

questions in 3 hours. We find merit in the submission advanced by learned counsel
for the petitioner that all the candidates would not have spent the same amount of
time in answering Part- A in the evening shift. Some candidates to whom the paper
was leaked, might have taken lesser time to answer Part- A as compared to the other
candidates who had no prior knowledge of the questions. The candidates who took
more time to answer Part- A would be left with lesser time to answer Part- B. Such
being the position, the decision to cancel Part- A will work to the benefit of such
candidates who had taken lesser time to answer Part- A because they would get
more time to answer Part- B as compared to the candidates who took more time to
answer Part- A. The decision taken by the department to cancel only Part- A of the
evening shift, therefore, is clearly arbitrary. The department should have cancelled
the entire paper of the evening shift.
We, therefore, have no hesitation in cancelling the decision of the
department to take a re-examination of question contained in Part- A only. The
department shall now hold a fresh examination for all 200 questions for the
candidates who had appeared in the evening shift.
The petitions, are accordingly, allowed to the extent indicated above.
Since the order has been passed in the open Court, the same shall be
communicated immediately to the department by learned counsel for the
respondents.
