This is to bring to your notice the unprofessional behaviour of SSC in delaying the result of CHSL 2015 and CGLE 2016. SSC had conducted the Tier 2 of CHSL 2015 exam on 18th September 2016. They declared the marks obtained by candidates in Tier 2 of the exam in the first week of January rejecting around 900 candidates who forgot to mention the medium in which they had attempted the exam. As a result the rejected candidates led by one Sumit Kumar filed a case in CAT challenging their rejection. CAT gave its judgement in favour of the candidates and asked SSC to evaluate the answer sheets of the rejected candidates. CAT clearly mentioned that its judgement was based on the previous judgements of The Supreme Court and High Courts in similar cases filed previously. CAT clearly stated that "The purpose of an exam is to select the candidates based on merit and not to reject them on trivial grounds. SSC could have turned the first page of the answer sheet to know the medium of the answers. In such cases filed previously the Supreme Court always rules in favour of the candidates." Now instead of evaluating the answer sheets of the candidates SSC decided to appeal in the Delhi High Court against the CAT's judgement and that too after 1.5 months of the CAT's judgement, thus unnecessarily delaying the process. The hearing date given by Delhi High Court is 17th JULY which would cause an unnecessary delay in the result declaration. What will SSC gain by appealing in the High Court when CAT has clearly mentioned in its judgement that its decision is based on the previous judgements of The Supreme and High Courts in similar cases filed previously?? It would not have taken more than 2 days for SSC to evaluate the rejected 900 answer copies as per CAT's order and final result could have been declared in May itself. But it seems that SSC wants to avenge its loss in the CAT case, by unnecessarily delaying the results. Also since the descriptive exam was conducted for the first time, SSC could have shown some leniency. Moreover, the rules of the exam framed by SSC should not be so undemocratic that even the judiciary finds them unjust. This would also delay the results of CGL 2016 exam which also had a descriptive paper conducted on 19th March 2017, since similar issue would arise there as well. So, It is in the best interest of everyone that SSC evaluates the answer copies of such candidates as per the CAT's order which would not take more than a week. The unemployed candidates who have limited resources have been waiting for the results of these exams for a long time. The process of these exams has already exceeded 1.5 years which is contrary to the Government's promise of completing the recruitment processes within 6 months. So, I would like to request the concerned authority to direct SSC to follow the CAT's order and declare the results of the aforesaid exams as soon as possible. �7��4
