CRPD/PO/2016-17/02 dated 04.05.2016 issued by the 2nd respondent and quash the same so far as it relates to the ineligibility condition that candidates with record of default in repayment of loans and/or against whose name adverse report of CIBIL or other external agencies is available are not eligible to apply for the post as arbitrary, unreasonable, unfair and against Article 13 and 14 of constitution of India and consequently direct the 2 nd respondent to issue a fresh notification so as to enable a large number of candidates to apply for the post of Probationary Officers in respondents bank. Prayer in WMP(MD)No.7823 of 2016 : To pass an order of stay staying the operation of the impugned advertisement No. CRPD/PO/2016-17/02 dated 04.05.2016 issued by the 2nd respondent bank. Prayer in WMP(MD)No.7824 of 2016 : To pass an order of injunction restraining the respondents from conducting the preliminary examination schedule to take place on 02.07.2016, 03.07.2016, 09.07.2016, 10.07.2016 and the main examination schedule to take place on 31.07.2016 in pursuance of impugned advertisement no.CRPD/PO/2016-17/02 dated 04.05.2016 issued by the 2nd respondent bank. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.Y.KRISHNAN, Advocate for the petitioner and of Mr.N.Shanmuga Selvam, Senior Panel Counsel for 1 st Respondent and Mr.S.Sethuraman, Advocate for respondents 2 to 4 and the court made the following order:- Mr.N.Shanmuga Selvam, learned Senior Panel Counsel for Central Government accepts notice on behalf of the first respondent and Mr.S.Sethuraman, learned Standing Counsel for the State Bank of India accepts notice on behalf of the respondents 2 to 4. 2.Challenging the following condition incorporated in the recruitment notification taken out by the State Bank of India for recruiting Probationary Officers through Advertisement No.CRPD/PO/2016-17/02, the present Writ Petition is instituted. The condition reads as under:- “Candidates with record of default in repayment of loans/credit card dues and/or against whose name adverse report of CIBIL or other external agencies are available are not eligible to apply for the post.” 3.According to the learned counsel for the petitioner, distressful financial condition of prospective candidates is made a condition for disqualifying them. Any such condition would amount to infraction of equality enshrined under Articles 14 and 16 of the Constitution of India. 4.Hence, Admit. Issue Rule Nisi. Call for records in eight weeks. 5.However, we consider that stopping examination or the selection process will cause more harm to the candidates across the breadth and length of this country and hence, the hardship that is likely to be felt out of any such stay of the recruitment process would be very high than the one faced by the candidates who have suffered the disqualification. Hence, balance of convenience, in our view, does not lie in stalling the selection process any further. Instead, selections made pursuant to this notification are made to abide by the result of this writ petition. 6.Tag this Writ Petition along with WP(MD)No.9632 of 2016. sd/- 06/06/2016

MY MIND STOPPED WORKING.. NOT ABLE TO DO EVEN SMALL MULTIPLICATION .. DONT KNOW WHETHER I GET SHORLIST OR NOT BUT WANT TO KNOW MY RESULT.
