  I have drafted an appeal for the relaxation of acuity standards.

Requesting the Govt. of India to consider the medical status of Refractive error in favor of the eligible candidates for A-2 Category in Indian Railways. 

Main Objective- To secure continuous Effective Service and that the of cases is found to the continuous effective service .

Allowance in the medical standards for the age and length of the service of the candidate: CEN 03/2015 invited applications from graduate Indian Nationals aged 18-32. We are 28 years old now. Since the time of joining Is Uncertain, the vision power will be influenced by the time. Considering my age and length of service, the allowance in medical condition should be considered as we have lesser service available compared to an 18year old candidate.

Paragraph 504 of Chapter 5of Medical examination empowers the government to relax any of conditions in favor of any candidate for special reasons.

Through your office I want to request the government to consider relaxing my medical condition (refractive error) in my favor, for the special reasons

- Medical condition influenced by the process time.

- Employment scenario in consideration. We make up to 10% of the optimal workforce that has been rejected for this reason in SWR.

- The medical condition and the work profile “neither has the possibility of any occupational risk nor does it interfere with the likelihood of continuous effective service”.

  

Government of India Ministry of Railways RRBs   on December 26th, 2015 via CEN 03/2015, invited applications for filling up   of the non technical popular categories from the eligible Indian nationals. 

 

There were multiple categories with different   medical standards for each. Applicants were to exercise the post preference   in accordance to their medical conditions and visual acuity. Options   exercised once shall be final. 

We opted for Traffic Apprentice & Goods   Guards as our first preference for our visual acuity was 6/6 while the post   asked for 6/9(without glasses).

 

The process involved two stages of CBT,   document verification followed by medical check-up and joining. The initial   notification, while the post options were to be exercised read only one stage   of CBT with tentative dates in March – May 2016.

Post medical tests in 2018, we received a   letter declaring us unfit for Aye Two due to refractive error. The letter   request for an acknowledgment of its receipt by the candidate. This letter is   being drafted in response to the same.

While applying, In Dec 2015, Considering the   tentative dates for CBT in May 2016, we exercised our best judgment while   opting for the post preference. Considering the maximum tentative time that   the process might take as per the indications as “One Year” little here and   there taken into account, we opted for TA and GG as our first preference. The   eyesight 6/6 and GP- 4200. 

The process took more than Two years to arrive at the medical test. It being certain that the   rejections due to Refractive error would be less or more as proportional to   the time. Increasing with increase in the recruitment process. Had we known   the time frame, the damage to the refractive capacities would have been calculative   and I would have opted for other categories offering similar grade pay and   lower visual requirements (Commercial Apprentice).

Everything decays with time. The human body   and the eyes in it is no exception. Our visual acuity has degraded with age and   time from 6/6(Upon application- Dec 2015) to 6/9(upon doc verification-Sep   2017) and to 6/12(upon medical- March 2018).

Have our eyes decayed to the extent that   interferes with continuous effective service? The answer is “ NO”. The refractive errors are   corrigible by a pair of spectacles to the required standards. In fact, the   spectacles for existing Traffic Apprentice employee are allowed as per   Chapter 5.

What would be in the better interest of the   Railways? 

A qualified, eligible   and verified candidate with negligible   medical error executes the operations with immediate effect OR no candidate working on that post   for at least another Two more years? For there is no standby list in our   categories.

It is certain that Our absence in the batch would lead to an increased workload on current traffic apprentice batch. This   would certainly have an adverse impact on the quality of output. Especially   while the department has ambitious plans of rapid transformation.

We are certain that we through this letter, the right to Equality of status and opportunity shall be withheld, If Not we shall be forced to take the matter to the courts.
