I have been (or I am?) having serious trouble with the 'perfect progressive' forms. Pls solve my problem:
This is OG12 SC Q74
A 1972 agreement between Canada an the US, reduced the amount of phosphates that municipalities had been allowed to dump into the Great Lakes
a) reduced the amount of phosphates that municipalities had been allowed to dump
b) reduced the amount of phosphates that municipalities are allowed to dump
Now 'had been' is used when an event (here dumping) has started in the past and is then followed by another event. So a) is wrong since the dumping is continuing in present. So OG says 'are allowed to dump' is correct
I would like to know wouldn't 'have been allowed to dump' been more appropriate since the action began in past, is continuing in present an may continue in future.
Now following is OG12 SC Q73,
Combining enormous physical strength with higher intelligence, the Neanderthals appear as equipped for facing any obstacle the environment could put in their path, but their relatively sudden disappearance during the Paleolithic era indicates that their inability to adapt to some environmental change led to their extinction

Before I begin the detailed analysis of this question, I will tell you one thing. The verb tense to have been equipped is related to verb tenses communicated by to verb. These tenses are relative to the main verb tense. I would suggest you note down its usage. You can read more at this link: Sequence of Verb Tenses
Now lets understand the meaning of the sentence in Q 73. The author is talking about a species - Neanderthals. He says that Neanderthals appear to be equipped to face any environmental change. He then presents a contrast indicated by the word - BUT. These Neanderthals disappeared suddenly in an era in the past. And this indicates that these species were unable to cope with some environmental change.
So this sentence is set in present time frame context - its as if the author is in present time frame and he is looking at a thing of past (since Neanderthals disappeared) and is stating certain facts using the two verbs - appear and indicates. These two verbs are relative to the author.
It appears to the author that Neanderthals were strong and intelligent. Some data indicates to the author that Neanderthals were not able to cope with some changes.
Thus, these two verbs should be in simple present tense. (Note this is why appeared is incorrect in choices D and E).
Now lets move over to "to have been equipped". Whenever you have "to verb", where verb is in present perfect tense have been equipped, then the action represented by this to verb happened in past relative to the other verb in the sentence. Lets put this in context:
Neanderthals appear to have been equipped.
Main verb - appear
To verb - to have been equipped
Since the verb in to verb is in present perfect tense, it implies (per the above discussion about the rule regarding to verb in present perfect tense) that this event happened prior to the main verb appear. And this is the intended meaning of the sentence.
Note here that appear to be equipped is incorrect because it would imply that to the author these Neanderthals still appear to be equipped. This is not correct since the author in the present context of time has already noted a contrast through the use of the word but. Refer back to the intended meaning discussion above.
