Mam, is also a Member of Mumbai University Paper Setters’ team for Business Law.This is the first time ever that an MBA Institute has conducted an Intra Institute Moot Court Competition. The object behind conducting the Moot Court Competition was to give the students a first time experience learning and practical know how as to how the Courts function in practice rather than just bookish knowledge and clear fictitious knowledge given through entertainment. Even a Manager may have to assist and appear in Court on behalf of his Company as the Company’s legal representative assisting, guiding and instructing the Advocate or Solicitor appointed by the Company to litigate Court matters of the Company. A Manager has not only to be well versed in his field of management but also in law.The Moot Court problem was based on Directors of a Parent Company who were also on the Board of Directors of their Subsidiary Company entered into contracts with their Subsidiary Company. Subsequently the Subsidiary Company was taken over by another Company who pointed out that the Contract Price was much higher than the Market Price, hence the termination of contract and recovery of damages and compensation. The problem also revolved around Section 188 of the Companies Act, 2013 pertaining to ‘related party transaction’ and ‘arms length price’; whether the corporate veil should be lifted; the Indian Contract Act, 1872 pertaining to contracts, the Income Tax Act, 1961 and the Second Amendment Act, 2016 pertaining to the definition of ‘arms length price’ as it is a statute in pari material for the interpretation and clarity of the ambiguious definition of ‘arms length price’ in the current case at hand.As the subject Legal Aspects of Business Law and Income Tax Law, The Indian Contract Act, 1872, The Companies Act, 2013 and the Income Tax Act, 1961 have all been taught in theory, the Moot problem was based on the very same Acts to give the students the experience learning and practical know how and applicability of laws through the Moot Court Competition.The students experienced all the three stages of :1. Research – gathering and collecting all the material through various Statutes, Citations (searching for case laws similar or identical to their case)., etc;
2. Drafting – putting all the research work together and drafting memorials
3. Presentation (Oral Representation or submissions) - this being the last stage of a mock trial where you present your case before judges.

NLDIMSR Jalsa: Where people danced for a cause!

Winston Churchill once said, ‘We make a living by what we get, but we make a life by what we give.’ These words were marked true by the students of N L Dalmia Institute of Management Studies and Research on the eve of 25th September, 2017. Around 170 students marked their presence and danced their hearts out for a cause initiated by the members of My Social Responsibility (MSR), a social service committee completely driven by the students under the guidance of Prof. Pius Moras.

NLDIMSR Jalsa was the first ever Garba night organised by NLDIMSR. The night was full of dance, fun and food. The sole purpose of this event was to raise funds for carrying out various activities under the aegis of MSR. The members of MSR worked day in and day out to make this event successful. A lot of energy and enthusiasm was showcased by the new members of MSR i.e. the first year students. The whole event was organised by the new members under the guidance of senior members. There were instances where the members felt whether the event would be successful or not. But hard work always pays off and so it did in this case too.
