I made a casual observation.. It has nothing to do with Judiciary or IIMs.

But yups, I do believe this time IIMs can be challenged.. as it is a valid grouse on the part of some candidates.. Besides, they might be sued for delaying the results as they had mentioned the April 12th date in prospectus..

I dont understand why the govt is shirking away from the core issue over here. WHY ? does it not order the states to conduct a caste based census with a deadline of 2 months? I know it wud be tough but certainly not impossible , particularly if its outsourced to some reliable agency. I think as long as govt does not provide numbers , HRD will keep cribbing about potential violence and other such stupid things.

I do understand OBC census will be tough , but then IIMs can arrange such tht the affected OBC students who may have to wait a bit longer before getting their coveted seat come to terms with the normal course by second year. Ya I know its far fetched and I may get brickbats for this , but this is a fact that Govt shud come to terms with. After all SC does in no way 'oppose' reservations. But its within the right of the judiciary to demand true numbers from the Govt in reply to the PIL published by YFE.

More asinine was Dr. Manmohan Singh saying that Judiciary shud not cross its limits I couldn't believe that man of his pedigree , stature and qualifications was saying this. Its about showing the numbers to the SC and satisfying SC , finished , nothing more , nothing less

I would not be surprised if some of these 55 candidates (or may be all) serve legal notices to the Six IIMs if the IIMs uphold their admissions. I do not think such a situation has any precedent and it would be very interesting to watch the battle.

What I find difficult to understand is that what will be the basis of their arguement! IIM's would not be implementing quota as per judiciary's directive. So if they file an appeal against this, wouldnt it become judiciary versus judiciary!!

I think what the words in the context mean is that Of the 55 shortlisted for GD/PI in IIMA - 25 were clearing the GEN cut-off. Now, those 25 will be considered along with 608 i.e. out of a total of 633 1st list of 185 will be announced.
Rest 30 will only be considered if the stay gets vacated and this 2nd list might contain 17-X OBCs and 7+X GEN and 6 SC/STs. X = Number of OBCs who made it under GEN in the 1st list.
Disclaimer - This is my interpretation and this is how it should happen logically.

They get away with anythng by mentioning "Other factors like work ex, profile " etc etc. However the way HC has made UPSC declare the marks of candidates, soon there will be some RTI agnst IIM and they will be forced to make things transparent.

people who have been rejevted will ask for quantifiable parameters and scores... and they will be unable to understand that many things such as temprament, sincerity etc... cant be measured on a 1 - 10... this will only give the iims a bad name... forcing them to pick candidates who r good at number crunching and with a good track record instead of candidates who hold good managerial potential...

Just my views... the quality will be diluted two folds...

First of all, I do not think IIMs do not quantify the results. As some1 else remarked correctly, in IIMs selection list, every candidate is awarded some ratings based on marks he has got from the available ones on their set of parameters. Now these parameters may include Patience, Temperament etc. and IIMs can justify them.

Besides, foreign B-Schools use quite subjective criteria and they also divulge reasons for rejection upon asking. So, it will only reform the IIMs selection process and not degrade it.

All said and done, there is a reason to IIM Profs adopting a more objective approach towards selection. In India, almost everything degenerates into nepotism when subjectivity is introduced, so IIM profs choose to remain as much objective as possible counting factors like Acads, CAT %iles, Sectional %iles, Work-Ex, GD Marks, and PI Marks for final merit list. For this reason, I do not think there are spot acceptances but spot rejection are there as they are placed on the bottom of the pile.

Guys relax... There is not much we can do right now except wait for the 21st. Since the IIMs have said that they will be coming out with a list on that date, I feel it is only fair that we give them a chance to do so.
Considering that the IIMs were bold enough to come up with a way to release the list as early as possible, we should support them. The IIMs also want this thing sorted out as soon as possible

So, people could claim monetary loss (travelling..), loss of opportunities in workplace, mental trauma etc etc. It's a fit case for suing the IIMs even though it is the government which is at fault.

Now hadnt I written 'if the IIMs withhold their admissions' (and not if they deny admissions) ? And as far as the legal aspect is concerned, the IIM's notification on OBC reservation was contingent upon the legislation passed by the government, which was passed, and not on the SC's clearing the act. The stay comes after the admission process has been completed and you cannot change the rules of the game once you play the game itself... remember Mr. Pasayat had said something like this to the governement on the OBC issue....????

I would have grabbed XL and ISB both under these circumstances. I am just trying to find out if there is anyone who has ditched ISB in a hope to convert IIM, coz thats a big risk.

Calling OBC candidates under OBC category even if they clear general Cut - Off is justified by the IIMs, because when the final list is prepared such candidates might not clear in General category, but they might clear it in the OBC category...in the final rankings I mean..right??

What I meant was there is nothing to prove the figure of 633 from the article, i.e., 25 OBC category students crossing the General cutoff. While some may have crossed it, I'm sure the IIMs wouldn't disclose it to a newspaper or a news channel. And as far as I'm aware, there is considerable dispute that has gone on about whether OBC students have been called under General category if they had cleared the GC cutoff. But I think that at least A and C have adhered to the correct norms, i.e., calling OBC under GC if they were eligible. And in my opinion, that is the proper way it should be done.

Also, it gives more erroneous statements like 6% increase in seats whereas the OBC quota is 6% and increase in seats is actually 12% and also says something about 27% quota rule, again factually incorrect.

I think what the words in the context mean is that Of the 55 shortlisted for GD/PI in IIMA - 25 were clearing the GEN cut-off. Now, those 25 will be considered along with 608 i.e. out of a total of 633 1st list f 192 will be announced.

Rest 30 will only be considered if the stay gets vacated and this 2nd list might contain 17-X OBCs and 13+X GEN. X = Number of OBCs who made it under GEN in the 1st list.

You are reading too much into the words of the media. Firstly, the article assumes all the increased seats (30 seats) are quota seats, assumed to be all for the OBCs which is not true. Only 17 are for the OBC quota and 6 of those 30 seats are General seats. So, the article has wrongly assumed that of the 55 candidates who were called under the OBC quota, 30 would obviously have been shortlisted for final admission whereas in fact, the correct no. is 17. And interpreting this to mean that 13 OBCs have cleared General criteria is totally wrong as people who were part of the shortlisted 55 can only be considered for the 17 OBC seats and not for the General seats as the fact that they were called under the OBC category implies that they had not cleared the General cutoff. Also, it gives more erroneous statements like 6% increase in seats whereas the OBC quota is 6% and increase in seats is actually 12% and also says something about 27% quota rule, again factually incorrect.

Because 192 is as per increased seats...

Any law, even if it is placed under the ninth schedule, may face a judicial scrutiny and could be struck down by courts if it violates the BASIC rights as enshrined in the articles 14, 15, 19, 20 and 21 of the Constitution.

Now for the government anything other than the above articles is seemingly unglaring...

hehe you are going too much into the words given by our media. It might have just said that of the 55 shortlisted they were to provide admissions to 30 (actually 17) to the OBCs under the quota rule. The IIMs who choose not to disclose the intricacies to the parties concerned, do you think they would disclose the breakup to the media especially when the results are not out ?????

But as per earlier reports, the two-judge bench is not sitting for this whole week, then how can govt approach it on wednesday ?

Precisely! This is a daily 'SBKBT' serial in which each day the episode ends with a suspense only to be unfurled the next day. The suspense, like the story, is ridiculous. I am sure the final episode of this serial would finish with the UP polls and the serial would be subdued only to gain momentum with a new version the next year
