We need around 10-15 petitioners from Delhi as we need domicile holders for the writ to be filed in HC of any state. The rest of the ppl across nation, can join the petition as PARTY TO THE PETITON, and would be equally eligible of any benefits that may come from the outcome.

Once its filed it shall take 4 working days for a hearing .......... 15 days one hearing . Possible outcome as stated by the lawyer ............
CAT 2009 to be NULL and VOID. Immediate relief by putting a STAY on all the on-going admissions. Conduct of RE-TEST as fair and just platform for all students.

The chases of such a ruling is very lowwe have to prove that gross mistakes have occured in conducting the exam in the form of proofs ............

This might be only for the ppl who qualified for the 2nd phase of the CAT, according to the 7 clauses given by the IIMs, but did not get a chance to appear for the re-test or vice-versa.


b. TRANSPARENCY

1. Why did you not inform people about the so-called financial fraud:w00t::w00t::w00t::w00t:, since you yourself mentioned that you knew it for so long? Please answer this question.
2. Why do you suddenly open a post where you bring about "BREAKING NEWS"? Why did you say all along that all is going well and try and support everything (until these sudden posts)? What were you doing hanging here for so long?
3. Why don't you file a WRIT yourself instead of discouraging people? After all, you were the person who pointed out time and again that we must all work together. Your dad is a SC lawyer, isn't it? Why don't you file a writ yourself?
4. People will be posting their passports and details in the Google Group so that authenticity can be verified.
5. What is your ulterior motive in discouraging people and destroying this thread? Surely, IT IS CLEAR THAT YOUR POSTS ARE INTENDED TO BREAK THIS MOVEMENT.
People, please use your common sense. You have lost a lot in CAT 2009. Please do not allow someone to destroy you at this critical juncture.
My request is that all of you join the google group and verify the authenticity. He intends to break this apart. We cannot afford it. There is nothing constructive in Abhisekh's posts.

Let me share some info on how the writ petition is filed in the high court


- First we have to prepare a final draft and get a date from the court

- Then with in a week we get a date ......on the same date either our case is selected or rejected ............

- If selected then the other party is given a time of ten days for answering ................

- Then it shall take minimum 2 -3 hearing for the case ( pls consult a lawyer )


- I have discussed what can be the possible outcomes ...... giving people false hope creating media hype for the firm and accumalating people and taking money from them on wrong pre text is fraud

It's saddening to see that someone so involved and seemed to be reliable Abhishek tried to manipulate people by calling them personally and asking them to follow his leadership game and ban ppl like raj, sowmya n i dunno who all ,,,these r the ppl who have worked day n nite to get us the petition ready, establish legal network and channelize the whole thing. Instead of being thankful to them, ppl like abhishek wanna make this a whole propaganda.
Dude I'm sorry to know such side of urs. I went with you yesterday for the meet and I did try to make u understand not to try to become a LEADER in this, it myt back fire..wish u'd have followed my suggestion.

If anyone interested in being a part of this campaign, and has even the slightest of the doubts about the ppl involved, FEEL FREE TO JOIN US IN THE SKYPE CON CALL tonyt by around 10ish.
This mis-guidance has been going on in this campaign since the beginning and I also blam Raj n team for not taking a good approach to reach out to the masses. I completely understand that when there is not enuf transparency from core team members in such campaigns, ppl tend be skeptical and lose faith in the proceeding easily, because such times give opportunities to ppl like Abhishek Khosla who want to be the NEXT PG MADCAPZ or woteva,,and do this jus to come in the lime light. Many close contacts of abhishek khosla have understood the entire case, have got in touch with the core team members and r already working on the contribution part in different zones.

It's an earnest request to the mods if they could close this thread coz it's not serving the purpose of making the ppl involved aware of the true information. It's only leading to mis-guidance.

I also invite all the mods, to the con call tonyt and find out for themselves what's really happening at the backend and how much ppl r really working. I have myself got a chance jus to grab a glass of milk since morning, coz the whole day gets wasted in just typing out JUSTFICATION MAILS/CALLS and proving that how dedicated ppl r putting in their precious time n enerygy into this !!! Also, RAJ is coming to Delhi tomorrow to meet certain activists and IIT-Delhi ppl for the support needed at the 2nd stage, and if anyone would like to meet him, may contact anytime on the numbers provided.

If at all the court feels that the exam were unfair , it can instruct the IIMs to re-conduct the process. This statement gives the impression that everybody who joins the petition will get a chance to GDPI. The guys who deserve to get a GDPI call on the basis of new merit list (on raw scores, maybe) can be called for GDPI.

Im sure this was precisely what you meant. kindly re-phrase your statement.

i second you. either it should be re-test or a re-evaluation based on raw scores. I think asking for direct GD/PI looks a bit weird. We should call for a just process whatever it be and then merit be the criteria for the shortlist.

Hi Ppl,


Lemme clarify certain prevalent myths first according to some facts that came to light in the last two days -


1. Most of the skeptical ppl out there think this whole Raj-&- Law firm is just a fake propaganda. He, with his team are just trying to fool ppl for their own monetary goals or woteva.
Ans. The law firm in Delhi that has been contacted by Raj's team is quite REAL, and one of the well established firms in Delhi, located in the Legal Hub of the city. The people we met [ 3 including the chief lawyer concerned] are quite genuine and REAL. They did not try to fool us with ambiguous information, but provided us with basic facts and figures. Infact, they helped us in understanding the ground reality in the case. Raj's Team is a team of 4 ppl, with 2 ppl who had appeared for CAT this yr and are in the same boat as us, and the other 2 have good legal and media contacts in Delhi, the result of which was that lawyer from this well reputed firm agreed to look into our case. Since these ppl knew that just 4 of the team members could not bring about any change and plus finance is also a concern, they went public, created a website, posted ad on PG and other places. They have NOTHING to do with PG or any such forum. As far as I see it, these ppl have really put in a lot of effort to make the lawyers interested and got all the data n facts in place for the rough WRIT draft to come out.

2. Sowmya is not so reliable and somehow seemed to have partnered with the Raj. We can't deposit money in her a/c.
Ans. This girl is just another member of this group, but an active one. She does not seem to have any personal partnership with Raj's team. She is as interested in getting justice to all as you and me. She was contacted by Raj's team just like ppl like abhishek khosla, sandesh and many that i haven't known yet properly to speak of. Apparently, she was one of the initial contacts established, and has helped a lot on the writ front, and generating leads for monetary support.
But, incase certain ppl do not feel comfortable depositing money with her, I'd like to suggest that
3. Why do we need Lawyers to file the writ. Anyone can do it.
Ans. YES. ANYONE can do it. But who can defend and argue the case in the court at the time of hearing. We already have time against us, so PIL is out of option as well.


4. Why can't lawyers file the petition and then we can pay him?
Ans. Are we living in Stone Age? The lawer is not your Dad or Mom who has opened an NGO to help ppl out. Get Real. A law firm is not some Kiriyana Store where they put up a board - "Udhar maang ker sharminda na karein" But you still have a "KHAATA" there. They are core professional ppl. No money, No honey.


5. Why do we need to hire such a big or a costly law firm?
Ans. True. We do not need to go to such so called hi-fi firm. But do you realize against whom are u fighting this case??? the IIMs,,,do u think they'll come up with some cheap-ass lawyer in your response to defend them? Expect a big name against our case.


6. The Law-Firm is involved just for media publicity.
Ans. All of us here are willing to spend time on this case for our own interests. We have suffered in ways more than one, hence we have a drive to get this done. Why would any law-firm help us when they know they can't extract big bucks from their clients that are mere STUDENTS?
The good thing is that the lawyers involved seemed to have a soft corner for us, and are willing to reduce their charges or the entire cost involved so that it's not a BIG problem for us to handle the financial scenario. They plan to hire a senior counsel who'd be ready to take up the case for name n fame and not for money [ yes there r many such lawyers out there, who take up cases for public interest and for media name or woteva]. There r certain lawyers who charge per hearing and some who charge a one-time fees. The firm has promised to find us a Senior Counselor who wud either take it up at a very low one-time fees or a lower per hearing fees woteva the case maybe.
[the entire credit for this goes to Raj's team coz it was their network that found us with an understanding and solid firm] I know some ppl feel that they have good law contacts and do not need this law-firm,,then stop TALKING, and START EXECUTING. We don't have so much time for all this crap. Get us the contacts if u know 'em and A.K. and I will get in touch. But if u can't then plz refrain from posting such stuff and de-moralizing ppl. Trust me, u r not doing good to ANYONE by such an attitude.

7. Getting involved in a legal battle would put a black mark on my profile or wud be a great hindrance in my regular routine. In short, a big pain in the arse.
Ans. Welcome to India. We have people who r just scared by the name - Police Staton, Court case etc. If I'll tell my dad tomorrow that I plan to be a part of this case, the first and the obvious reply would be - "Chup kar ke ghar baith jao. Career pe dhyaan do. Ye sab kar ke kuch nahi milta." Why do they say that? BECAUSE they themselves have never got involved in such thing or they do not have the complete information or the nitty-gritty involved. When you become a petitioner for the WRIT, [this is Delhi HC specific], you just have to sign the petition with your law-firm, and give them the power of attorney to represent you in the all the matters concerned. YOU DO NOT HAVE TO VISIT THE COURT IF YOU DO NOT WANT TO. But yes, we do need some ppl to represent the entire petition group on the first hearing. We need to tell our parents that if all of us would think that "KUCH NAHI MILTA YE SAB KAR KE" then this system will become so evil ridden one day that it'll be hard for all of us to survive peacefully in the society.
We all need to understand that LAW is there for our own good and is MEANT to be used in such circumstances.


8. Why can't i file in RTI and get done with?
Ans. Many of you who tried this would be aware that IIMs are simply re-directing ur appeal to the Prometric, which happen to fall out of the scope of Indian Judiciary. Basically, they play you like a table tennis ball.


Enuf of gyaan i guess.


Now, coming to the important issues at hand:


1. All of us, and not just DELHI ppl, have ONLY 8-9 days MAX, to pull this off and get the writ filed. This limit is according to the ongoing selection process in the colleges across the country. If we are not able to get this done in a weeks' time, then it is of no use at all. We are already so late into this, that we r losing the battle by the days that go by wasted.


2. The reason WHY we are filing the writ in the HC, is becoz in the SC, it takes around 25-30 days for a writ to get listed, but in the HC, it gets listed within 3-4 days. That is when HC will decide if the case is meritorious enough to be considered or not. So within a working week of filing the petition, we can get to know if we are in the game or not. If we are ON, then good news, the court will give the IIMs a notice of around 10 working days to come up with the defense. Now it's a speculation that if all goes according to the plan n prayers, our case is solid enuf to get a STAY on the matter within 2-3 hearings of the case, i.e. in the span of 45 days [optimistically]. No, it is not the sunny deol scene of 'tareekh pe tareekh'. In the writ petition, things r in the expedite mode. [read: HOPE]

4. Do we need any monetary support for all this? DEFINITELY YES.
We could discuss the money matters with the lawyers, and to start off with the case, we are looking at an amount of around 45-50k. And then, it all depends on the proceedings, but the firm gave its word, that they'll try to give us upper cap amount and make sure it is not crossed in any way possible. I'm not quite sure of the exact number of supporters that myt turn up after we get the dice rolling, but i'm sure when media covers this writ and the related movement, pressure on the court can be generated and ppl will definitely join us in great numbers.

5. WHAT ARE WE FIGHTING FOR?


This is a tight one actually. I happened to go thru' the rough draft, the PRAYERS part - three outcomes have been sighted so far:


a. CAT 2009 to be NULL and VOID. Immediate relief by putting a STAY on all the on-going admissions. Conduct of RE-TEST as fair and just platform for all students.

The chases of such a ruling is very low we have to prove that gross mistakes have occured in conducting the exam in the form of proofs ............

This might be only for the ppl who qualified for the 2nd phase of the CAT, according to the 7 clauses given by the IIMs, but did not get a chance to appear for the re-test or vice-versa.


b. TRANSPARENCY

Of the marking scheme and the normalization involved. Raw scores and the normalization model to be shared with the students to help them understand what went wrong.[ we need the details of all the RTIs involved here,,A.K. will update u on this ]

c. Get GD/PI slots for the petitioners in the on-going process and provide them the opportunity to prove themselves.

6. Do we have a back-up plan?


Ans. Yes. there is one. If nothing happens in DElHI by this week end, then we'd suggest ppl in other cities to go ahead and file a writ with their HCs and others can be a party to them as I explained earlier.


7. HOW CAN I CONTRIBUTE TO THE MOVEMENT?


Ans. Well, by now, you should ask yourself the question - AM I AWARE and INFORMED ENOUGH TO COME OUT IN OPEN AND DO WHAT IS RIGHT OR SHOULD I JUST BE ANOTHER FACE IN THE CROWD AND WATCH THE SHOW???


I'll tell you what my motive is. [and of most of the ppl that i came across in the meeting today] - I have accepted my scores, and really do not care about the result anymore. I know I deserved a lot better than what I got, but even if anything changes, the fire for a deserving percentile is dry n out in me now. I don't need to prove to anyone what I really am. Or rather, I don't need percentiles to prove that for me.


I'm just so sick of the core fact that IIMs believe, that because they are the GOD college of this foolishly emotional nation, they can do anything under the sun, and still get away with it, without being ACCOUNTABLE to ANYONE!!!

I wanna do this because I feel I need to raise my voice to let them know they are highly mistaken. AND THIS IS THE ONLY WAY I FEEL I CAN DO SOMETHING ABOUT IT.

Today, in the Delhi meet [ first of all, it was not any PG meet], so let's call it the protest meet, not many could turn up as today being a weekday, and we here completely understand this. Some ppl text-in their reasons for the same, and we respect that. Ppl, jus try to manage ur time well on the work-front as this campaign demands a lot from each one of us.


5. @the meet, a known member from PG, Tarun Chawla was also present, and he has promised support from the mods at PG to help all of us across the nation for a full power campaign. I hope, things really work out.


Guys, none us wanna be leaders or anything,,but we don't want ppl from other places who have worked so hard, to suffer coz we could't sort out our mis-understandings.



I Hope things get sorted out after this mail, and we all could work things out among each other. I do not intend to preach so much, but just felt like sharing my thoughts with all of u out there because I did see some light after the meeting today.

No hard feelings. If we are hardpressed for time, Let's buckle up adn work from every side. Let's not leave any stone unturned, instead of getting demotivated. Please do your part and put all your effort in only thinking of ways to make this a success. any and every small step gets us one step closer to success. So, the more and the bigger, the steps, the faster we get closer.

I'm not experienced in this but I can say that it is the core people in the group who are doing this day and night who are bearing the brunt of both the workload and some unfair uncalled for comments. It is not fair to them. Nobody has a gun to his head, it is everyones individual initiative to come together for justice. That said, without everyones support it will only be harder.
I hope everyone takes this in a good way it is only my personal opinion.
Let us try to support them as it is our only chance.

monday, thursday and lot more dates are we listening about WRIT but seems raj is trying to manage the whole case as its a tech fest stuff and we are running for sponsors, dude this is reality and no one will come forward, without anything concrete.

Dude, writ has to be filed in Delhi,,I don't think raj n his team can do anything about that. We delhi guys need to get together to get it done. As far as my understanding goes, his team is focusing on the next step. Writ filing has been delayed due to our own mistakes,,none of the delhi ppl [ or shall i say a negligible number] came out to support the case.
But things have started to look up now. Hopefully things should work out well.

@Abhikhos - bro, why u groaning everywhere,,are we on the same plane?? If not,,call me tomo,,i think something's troubling u. Let's share it. Time to get serious with this case man,,it's now or neva.

I personally feel that our sole focus shall be on the legal process . . The focus is cat injustice , chatting , sending messages is very simple we want things on the ground in the form of rti , rti replies , all those people who received rti replies can file an appeal ( Shubham Hope u are listening )

See personally, I checked the feasibility of me filing a WRIT and I came to the conclusion that I won;t be doing it. I am therefore not in a position to point fingers & have stopped taking active part as such and I am ready to support anyone either you or Raj or Puneet or mr. abrakadabra whoever can take this forward. I can provide any docs or whatever you want (BTW I had my 1st appeal hearing yesterday... which was useless) .

Secondly coming to media hype, I believe it will follow if writ is filed - same thing which I shared in our group; Cause neither much time is left nor do we have much work force.

See the point is, we or rather all of you need to think seriously on all these matter as you guys have quite decent base ready in legal terms and now its upon you.
I am not getting restless neither am I trying to say go and file the writ; I am just saying if some trust is lacking anywhere either try to iron things out or keep your plans ready.

If the amount of money being asked is small, I really wonder why there has been so much of focus on collecting money right from the beginning.

Regarding the image, after all the unexpected verbal groans, i can expect few deadily comments for the SAVE CAT logo.
In defense, we are focusing on our writ totally. Our team had worked for more than 20 hrs on the writ after it was drafted by the lawyer. The final writ is ready. Munira is talking to our lawyers today, after which it is possible that some more points might be added, but overall it is almost done. We are in urgent need of a lot of petitioners and supporters. Delhi people are doing their work of getting petitioners from their personal contacts, but the participation will increase multiple folds if everyone can send a mailer to all ur contacts and make them aware of our initiative so that they can come ahead and help us. We'll get a mailer drafted and all those who have registered at Home or have joined the google group will get that mailer. Others can use this poster in their collges, their coaching institutes etc.

It 'll save our time after filing the writ, because writ filing is not the difficult task, gettign a stay and winning the case is. To win, we need mass.

Sir, it is small money per individual and BIG money overall, which w couldn't have afforded by ourselves. I hope you are understanding the concept of convergence.

That is a personal view. we have top legal advisors with us, which doesn't guarantee success, but for sure enhances its possibility. Harsha's case satisfies your point of view-point and i am in touch with him personally. Out of everything we have decided to go in mass and we won't be reconsidering going alone at all as there are many who have suffered and I don't see a reason to go alone when we have better options.

Truly you are answerable to the posts here, and hence we have made our own google group. We also have our site Home and we proposed to move the disussions there. Now that PG has troubles and accountability is an issue, we would encourage all to keep the discussion restricted to google groups or Home We might also be revamping the site for better ambience so that they feel comfortable.

It totally depends on the parameters on how you classify a talk as "fantasy". I was monitoring the threads where ppl were spamming ministers mailboxes, to get a re-test. If that doesn't qualify for a "fantasy" I assure you, we are far away from the line.

On a serious note, we are really hopeful of a positive result out of this fight. If not help, please provide us a calm environment to work.
